Staff Report
SUBJECT:
Approval of Plan No. 11924 and Resolution Ordering Vacation— Summary vacation of Rollins
Way, north of Norman Road and east of Foisy Street.
BACKGROUND:
On September 18, 2006, an application was received from John M. Magness on behalf of
Hillwood Investment Properties, requesting the vacation of Rollins Way, north of Norman Road
and east of Foisy Street. This vacation is being requested for the purpose of constructing a
detention basin for several Hillwood projects, including the Gateway North and Gateway South
industrial development projects located on Central Avenue west of Tippecanoe Avenue.
Attached is Plan No. 11924 showing the proposed area to be vacated and a vicinity map showing
the general location of the proposed vacation.
Pursuant to Section 8331 of the Streets and Highways Code, a street may be summarily vacated,
without notice and hearing if both of the following conditions exist:
(a) For a period of five consecutive years, the street or highway has been impassable for
vehicular travel.
(b)No public money was expended for maintenance on the street or highway during such period.
Rollins Way is unimproved (a paper street only)—it has been an impassable street for at least
five consecutive years and no public money has been used to maintain this street. Therefore it
meets the conditions for a summary vacation.
On October 4, 2006, all city departments and utility companies were notified by mailed notice to
determine if any conflicts exist with the street proposed to be vacated. No conflicts and no
reservation of easements were requested.
FINANCIAL IMPACT:
None.
RECOMMENDATION:
Staff recommends that Plan No. 11924 showing the vacation of Rollins Way, north of Norman
Road and east of Foisy Street be approved and the resolution ordering the summary vacation be
adopted.

RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE
3 SUMMARY STREET VACATION OF ROLLINS WAY NORTH OF NORMAN ROAD
4 AND EAST OF FOISY STREET.
5 WHEREAS, the Mayor and Common Council of the City of San Bernardino desire to
6 summarily vacate Rollins Way, north of Norman Road and east of Foisy Street, in the City of San
7 Bernardino, without notice and hearing; and
8
WHEREAS, the area proposed to be vacated is more fully described as follows:
9
10 All of that certain north/south street, 50 feet wide and lying north of Norman Road, delineated as
Rollins Way on the Map of Valley'Truck Farms No. 4 Subdivision as per plat recorded in Book
11 31 of Maps, Page 95, records of the County Recorder of San Bernardino County, State of
California, being adjacent to Lots 30 through 34 of said Valley Truck Farms No. 4 Subdivision to
12 the east, and Lots 64 through 68 of said Valley Truck Farms No. 4 Subdivision to the west.
13 For further particulars as to the proposed vacation, see the map marked "Plan No. 11924",

approved concurrently on December 4, 2006 attached and incorporated herein as Exhibit"A".

16 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
17 SAN BERNARDINO AS FOLLOWS:
18 SECTION 1. That the Mayor and Common Council of the City of San Bernardino elect
19 to proceed with the summary vacation as described above, under and in accordance with the
20 provisions of the "Public Streets, Highways, and Service Easements Vacation Law", being
21
Division 9, Part 3 of the Streets and Highways Code of the State of California.

23 SECTION 2. That pursuant to Section 8331 of said Streets and Highways Code, the
24 Mayor and Common Council do hereby find that said street may be summarily vacated, without
25 notice and hearing, for the following reason: said street to be vacated has been impassable for
26 general public vehicular travel for a period of five consecutive years and no public money has
27
been expended for maintenance on the street during such time period.

3 SECTION 3. It is hereby determined that the vacation of said street is categorically
4 exempt from the requirements of the California Environmental Quality Act (CEQA), pursuant to
5 Class 1, Section 15301(c).
6 SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing
7
easements for public utility purposes belonging either to the City of San Bernardino or to any
8
9 public utility that existed prior to these vacation proceedings.
10 SECTION 5. The City Clerk is hereby directed and authorized to file a certified copy of
11 this Resolution with the County Recorder of San Bernardino County, and shall not take effect
12 until such filing.

Resolution No. 2006-421 -Resolution of the City of San Bernardino ordering the summary street
