Description) N/A Finance: Council Notes: q/g)9L Agenda Item No. ILJ CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Authorization to proceed with Sale of a portion of City Property to San Bernardino Valley Municipal Water District located at 1350 South "E" Street and Resolution Setting a Public Hearing BACKGROUND: On February 15, 1960, the City had purchased this property from the City of Riverside. The total size ofland purchase was 3.55 acres or 154,638 square feet. On May 23,1966 Resolution No 8184 was adopted authorizing a fifty year lease at $1.00 per year with the San Bernardino Valley Municipal Water District. Per the terms oflease, the Lessee was to construct an administrative building for the use of the Lessee and the public. July 28,1969, Resolution No 9920 was adopted authorizing the execution of a second Amendment to the lease, which permitted the Lessee to construct a storage and workshop building. On December 19,1994, Resolution No. 94-380 was adopted to sell approximately 135,000 square feet of the land with the structures to San Bernardino Valley Municipal Water District for $190,000 or $1.40 a square foot. A sale agreement was signed by both parties to sell any remaining land or buy back any excess land for $1.40 a square foot. Either party has first priority to purchase the other parties land if they wanted to sell or the first right of refusal to purchase the property. The City retained 13,500 square feet for a sewer lift station. The City fenced off this lift station leaving an excess of2.25 feet on the West and 6 feet on the south of the property line fence, a total area of 965 square feet. The San Bernardino Valley Municipal Water District, would like to acquire this 965 square feet ofland from the City of San Bernardino for expansion. The City water department has investigated this proposal to sell a portion of land adjacent to the department's pump station and determined no conflicts would exist. Based on the existing sale agreement between the City of San Bernardino and San Bernardino Municipal Valley Water District, the dollar amount per square foot would remain the same until December 31, 2019. The dollar amount worked out to be $1.40 a square foot for the land they purchased from the City. The price for the 965 square feet at $1.40 a square foot would be $1,350.00. Under the City's Municipal Code Section 2.65.050, City owned property could be sold to another Public Agency without competitive bidding. The Resolution setting a Public Hearing at 10:00 A.M. October 5, 1998, has been attached for your action also. G) o z a. c( 2 w W fIl . . . ~(Q)L9>W 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING AND 3 SETTING FAIR MARKET VALUE AND SALES PRICE OF 51,350.00 AND DECLARING THE INTENTION OF THE CITY TO SELL A PORTION OF 4 PROPERTY LOCATED AT 1350 SOUTH "E" STREET IN THE CITY OF SAN BERNARDINO, TO THE SAN BERNARDINO VALLEY MUNICIPAL WATER 5 DISTRICT AND SETTING A PUBLIC HEARING TO CONSIDER SAID SALE. 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 7 SAN BERNARDINO AS FOLLOWS: 8 9 SECTION 1. The public interest and convenience require the sale of approximately 965 square feet, a portion of property located at 1350 South "E" Street in the City of San Bernardino 10 to San Bernardino Valley Municipal Water District which provides wholesale water services to 11 12 the City of San Bernardino which is of benefit to the public. 13 SECTION 2. It is therefore the intention of the Mayor and Common Council of the City 14 of San Bernardino to sell said property to the San Bernardino Valley Municipal Water District. 15 16 Fair Market Value of the property and sales price is One Thousand Three Hundred Fifty Dollars, 17 18 19 20 21 22 SECTION 3. The Mayor and Common Council do hereby find and determine that the ($1,350.00) SECTION 4. The Mayor and Common Council of the City of San Bernardino do hereby set public hearing to be held on Monday, October 5, 1998, at 10:00 a.m. or as soon thereafter as the matter can be heard, in the Council Chambers of City Hall, 300 North "D" Street, San 23 Bernardino, relative to the proposed sale. SECTION 5.
