COUNCIL ACTION STAFF REPORT Soon after the Contractor started laying pipe, it became evident that there had to be a sewer lateral to serve the commer- cial complex on the northeast corner of Mill Street and Rancho Avenue. The City of Colton was notified and a field inspector came to the project site. This inspector stated that the City of Colton had no record of the location of this sewer lateral, and he could provide no assistance in locating the lateral. The Contractor did some exploratory borings in an attempt to locate the lateral, but was unsuccessful. Since there was no other reasonable alternative, the Contractor commenced the pipe laying operation. While excavating the trench for the 42- inch storm drain, the lateral was uncovered, and found to be in direct conflict with the design profile of the storm drain. The Contractor was forced to. suspend the pipe laying operation, in order to allow for the profile of the storm drain to be revised, so as to avoid the sewer lateral. A claim was submitted by the Contractor, in the amount of $6,221.10, as compensation for the eight (8) hours lost due to having to shut down to allow for the re-design of the profile. A larger than normal crew, with appurtenant equipment, is required for pipe laying operations. We have reviewed the backup information submitted with the claim and have determined that it is fair and reasonable. The total estimated project cost, based upon the actual low bid price, contained an amount of $24,700 for contingencies, which can be used to finance the cost for this change order. Since the time lost due to the conflict with this sewer main was not the Contractor's faul t, we recommend that Change Order No. One be approved, 8-02-93 75-0264 . .
