This resolution creates a Crime Free Zone pursuant to San Bernardino Municipal Code
Chapter 9.96. The Target area, as defined in the resolution, has been determined by the Police
Department to be the highest crime area in the City. As the resolution states, there have been 110
Part I Crimes and 228 narcotics related crimes from January 1,2006 to August I, 2006 in the
Target Area, there were 239 Part I Crimes and 257 narcotics related crimes from January I,
2005 to January I , 2006;there were 232 Part I Crimes and 147 narcotics related crimes from
January 1, 2004 to January I, 2005 in the Target Area, and there were 207 Part 1 crimes and
119 narcotics related crimes from January 1, 2003 to January J, 2004 the Target Area. The
narcotic activity and violent crime has risen significantly in the Target area in the past three
years. Please see attached statistics from the Police Department.
By establishing the Target area as a Crime Free Zone it will enable the City to work with
Probation and Parole to insure that all Probationers and Parolees have, as a part of their terms and
conditions of release, a requirement to stay away from the Crime Free Zone. Additionally the
City will concentrate its police, fire, code enforcement and other resources in this area to
eradicate crime.
Additionally, loitering in the Crime Free Zone is a misdemeanor and provides for a
mandatory sentence of probation with a term requiring the defendant to stay away from the
Crime Free Zone. This will allow us to keep individuals that are not on probation or parole out
of the Crime Free Zone if they are caught loitering.
This program will require that the City Attorney, District Attorney, Police Department,
County Probation, and State Parole work together. The District Attorney has agreed to seek terms
and conditions on all defendants that they prosecute for drug related crimes to stay away from the
Crime Free Zone. County probation has also agreed to add such terms. State parole has already
been adding terms to new parolees to stay away from the Crime Free Zone.

4 SECTION 1. Recitals
5 WHEREAS, the Target Area depicted on the map attached hereto as Exhibit A is an area
6 that the Chief of Police has determined to be the highest crime area in the City of San Bernardino;
7 and
8 WHEREAS, there were 110 Part I Crimes and 228 narcotics related crimes from
9 January I, 2006 to August I, 2006 in the Target Area; there were 239 Part I Crimes and 257
10 narcotics related crimes from January I, 2005 to January I, 2006; there were 232 Part I Crimes

16 WHEREAS, in accordance with the provisions of Chapter 9.96 of the San Bernardino
17 Municipal Code which establishes the criteria for a crime free zone, and based on the additional
18 information presented at this meeting, the Mayor and Common Council desire to designate the
19 Target Area as a Crime Free Zone.
20 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
21 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
22 SECTION 2. The Mayor and Common Council finds and determines that each of the Recitals set
23 forth above is true and correct.
24 SECTION 3. The Mayor and Common Council finds that the Target Area as depicted in Exhibit
25 A, attached hereto and incorporated by reference, meets the criteria set forth in Section 9.96.030 of
26 the San Bernardino Municipal Code and therefore is hereby designated as a "Crime Free Zone."
