Description) Finance: Council Notes: 75-0262 Agenda Item No. ,, /0 114 /off STAFF REPORT Council Meeting Date: TO: Mayor and Common Council FROM: City Attorney's Office DATE: October 11,2006 AGENDA: October 16, 2006 Sex offenders have very high recidivism rates and are the least likely to be cured and the most likely to reoffend and they prey on innocent members of our society. More than two-thirds of the victims of rape and sexual assault are under the age of 18. Sex Offenders have a dramatically higher recidivism rate for their crimes than any other type of violent felon. Therefore it is necessary to enact this ordinance to better protect the citizens of the City of San Bernardino. This ordinance will prohibit any person convicted of a sex offense and required to register pursuant to Penal Code §290 from establishing residency within 2000 feet of any public or private school, park, designated public school bus stop, day care center, park playground, or other place where children regularly congregate. The ordinance will also make it a misdemeanor for any person to knowingly rent to a sex offender any place that is within 2000 feet of any public or private school, park, designated public school bus stop, day care center, park playground, or other place where children regularly congregate. This ordinance will better protect the city's citizens, their children and the community safe from the threat posed by sex offenders. It also provides that if a property owner becomes aware of the tenant's status as a registered sex offender that the owner must initiate formal court eviction proceedings within 20 days of obtaining that knowledge. Violation of this section will also be a misdemeanor. Any person found to be in violation of this ordinance will be guilty of a misdemeanor, punishable by up to 6 months in jail and/or $1000.00 fine.
