"- CITY OF SAN BERNARDINO-REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Amendment # I to Resolution authorizing the submittal of a multi-jurisdictional application for designation as a State Enterprise Zone, and a Memorandum of Understanding among the City, City of Colton, County of San Bernardino, and Inland Valley Development Agency. Background: The Enterprise Zone Program administered by the State Department of Housing and . Community Development (HCD) targets economically distressed areas throughout California. Special state and local incentives encourage business investment and promote the creation of new jobs. The purpose of the Enterprise Zone program is to provide tax incentives to businesses and allow private sector market forces to revive the local economy. On August 21, 2006 the City Council approved Resolution 2006-299 authorizing the submittal ofthe application to the State of California. In its initial review, the State Department of Housing and Community Development noted several discrepancies or deficiencies in the application that require clarification or correction. One noted change is the requirement to designate a signatory for certain documents. The following signatory additions are included in this action: The County of San Bernardino has been designated the Zone Manager and its Director of Economic Development is authorized as the HCD Contact and signatory for Enterprise Zone documents; the City Manager is authorized to sign the Enterprise Zone Application; and, the City's Development Services Director is authorized to sign the environmental review process documents. the resolution is being amended to reflect the change in signatory from the Mayor's Economic and Community Development Adviser to the County's Director of the Department of Economic Development. The Mayor's Economic and Community Development Adviser is deleted as signatory by this Amendment. Financial Impact This action is necessary to complete the application process and has no direct financial impact. Recommendation: Adopt Amendment #1 to the Resolution approving the MOU and application. '\ ....d c 1 RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION 2006-299 APPROVING A CERTAIN 3 MEMORANDUM OF UNDERSTANDING IN CONNECTION WITH THE APPLICATION TO THE STATE OF CALIFORNIA FOR THE DESIGNATION OF AN ENTERPRISE ZONE 4 WITHIN A PORTION OF ITS TERRITORIAL JURISDICTION. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. Section 4 of Resolution 2006-229 is hereby amended to read as follows: 7 8 "The City Manager of the City of San Bernardino is hereby authorized to execute on behalf of the City of San Bernardino the application for the proposed Enterprise Zone. The City of San Bernardino shall act as Lead Agency, as defined in section 21067 of the Public Resources Code of the State of 9 10 California, in required environmental determinations, including but not limited to, the final 11 certification of an Environmental Impact Report. The City of San Bernardino's Director of the 12 Department of Development Services, or his or her designee, shall execute the Memorandum of 13 14 Understanding attached as Exhibit "B" and is hereby authorized to execute all documents required for the environmental determination. The City of San Bernardino acknowledges that the County of San 15 Bernardino's Director of Economic Development, or his or her designee, is designated as the primary 16 contact person for the Enterprise Zone and the primary contact with the California Department of 17 18 Housing and Community Development and shall execute such documents as required on behalf of the County of San Bernardino. The City of San Bernardino's Economic and Community Development 19 Advisor's authority to execute documentation as set forth in Resolution No. 2006-229, is hereby 20 revoked. 21 SECTION 2. Section 4 of Resolution 2006-299 shall read as follows: 22 "SECTION 5.
