ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
NO. 3695 ENTITLED IN PART "AN ORDINANCE . . . ADOPTING THE UNIFORM
BUILDING CODE, 1976 EDITION. . ."; REQUIRING THAT EARTH AND
OTHER MATERIALS, DEPOSITED ON STREETS OR ADJACENT PROPERTIES AS A
RESULT OF CONSTRUCTION ACTIVITIES, BE REMOVED WITHIN 24 HOURS.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. Ordinance No. 3695 Section 5, which amends

the Uniform Building Code, 1976 Edition, by adding sections and
9
subsections, is amended by adding a new Section 7014.5 to read
10
as follows:

"7014.5.
(al General. All parties performing grading
12 operations, under a grading permit issued by the City Engineer,
13 shall take reasonable preventive measures, as directed by the
14 City Engineer, to avoid earth or other materials from the premises
15 being deposited on adjacent streets or properties, by the action
16 of storm waters or wind, by spillage from conveyance vehicles or
17 by other causes.

(bl Removal of Materials Within 24 Hours. Earth or other
19
materials which are deposited on adjacent streets or properties
20
shall be completely removed by the permittee as soon as practical,
21
but in any event within 24 hours after receipt of written notice
22
'from the City Engineer to remove the earth or materials, or within
23
'such additional time as may be allowed by written notice from the
24
ICity Engineer.
