ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
NO. 3847 ENTITLED IN PART "ORDINANCE . . . PRESCRIBING RULES AND
REGULATIONS GOVERNING THE SUBDIVIDING OF REAL PROPERTY . . ."; AND
PROVIDING THAT STREET LIGHT SYSTEMS MUST BE DEDICATED TO THE CITY
BY DEVELOPERS UNLESS THE MAYOR AND COMMON COUNCIL EXPRESSLY
AUTHORIZE INSTALLATION BY THE UTILITY OR ATTACHMENT TO ITS POLES
OR SYSTEM.
I THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Ordinance No. 3847, Section 10, SUbsection

10.100 Paragraph (b) is amended to read:

"(b) After final approval thereof, such facilities and

i systems shall become the property of the City. The systems
I
I shall not be installed by a public utility or attached to poles
I or to a system in existence prior to the filing of the tentative
map, except when such installation or attachment is expressly

the Mayor and Council.

The Mayor and Council may grant a variance from the pro-
17
visions of Subsection 10.100 when physical conditions existing
18
prior to the filing of the tentative map require an alternate
19
type of system."
