Jtdo oPd- g I Agenda Item No. /CJ ?-7-()b e e e CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subject: Resolution authorizing the Mayor to execute Amendment No. 2 to the Services Agreement between the City of San Bernardino and New Hope Missionary Baptist Church to provide community services at the New Hope Family Life Center. Background: In FY 2004/2005, Resolution No. 2004-235 was adopted authorizing the Mayor to execute an agreement between the City and New Hope Missionary Baptist Church to provide community services at the New Hope Family Life Center. On July 18,2005, Amendment No.1 was approved to extend the contract for an additional year. The second year of the agreement was successfully concluded. New Hope Missionary Baptist Church has significant community service experience that contributed to a successful second year of the original agreement. Services provided include: rental and utility assistance, short term housing assistance, clothing closet, job referrals, tax preparation assistance, tutorial programs, senior nutrition programs, food referrals, Social Security assistance, imd arts and leisure classes. If approved, New Hope Missionary Baptist Church will continue to provide these services. The New Hope Missionary Baptist Church currently has one full-time employee, one part-time employee, and several volunteers assisting to ensure that all programs and services continue. This agreement is only for six months. New Hope officials are evaluating their ability to continue the defined scope of work at the current funding level. Changes to the contract are as follows: 1) Contract reduced from one year to six (6) months; 2) Contract amount will be reduced from $60,000 to $30,000; 3) Contract will terminate on January 31, 2007. Financial Impact: The budget for this program has been incorporated in the approved general fund budget for FY 2006/2007. Recommendation: Adopt Resolution. RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AMENDMENT NO.2 TO THE SERVICES AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO AND NEW HOPE MISSIONARY BAPTIST CHURCH TO PRO\lDE COMMUNITY SERVICES AT THE NEW HOPE FAMILY LIFE CENTER. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said City Amendment No. 2 to the Services Agreement with New Hope Missionary Baptist Church to provide community services at the New Hope Family Life Center for the period of August 1,2006 through January 31, 2007, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set 12 forth at length. 13 SECTION 2. The authorization to execute the above referenced agreement is rescinded 14 if the parties to the agreement fail to execute it within sixty (120) days of the passage of this . . Exhibit "A" AMENDMENT NO.2 TO THE SERVICES AGREEMENT This Amendment No.2 to the Services Agreement is entered into this day of , 2006, by and between the CITY OF SAN BERNARDINO and NEW HOPE MISSIONARY BAPTIST CHURCH relating to the operation of the Westside Community Services Center (a.k.a. New Hope Family Life Center), located at ISOS West Highland, San Bernardino, Ca. 9241 I. I. The Section entitled "I. fA) SCOPE OF SERVICES" is hereby amended to now read as follows: "Operate the community services center from Monday through Friday 8 a.m. to S p.m. exclusive of the following holidays: September 4, November 10, November 23 & 24, December 2S & 26, December 30, January 1 & 2, 2007, and January IS, 2007. 2. The Section entitled "2. COMPENSA nON AND EXPENSES" IS hereby amended to now read as follows: "For all of the above services provided, City agrees to pay CONSULTANT compensation for a six month period in the amount of $37,800. The fee shall be paid in installments of $6,300 with the final payment being $6,300 by the 101h of each month. The fee for services will cover all basic expenses incurred by the CONSULTANT on behalf of the CITY. CITY shall reimburse no other expenditures made by CONTRACTOR without the prior written approval of the CITY." 3. The Section entitled "4. TERM: SEVERABILiTY." is hereby amended to now read as follows: "The term of this Agreement shall be effective from August 1, 2006, through January 31, 2007 with the option of one, I -year extension upon mutual consent of the CITY and CONSULTANT. This Agreement may be terminated at any time by thirty - (30) days written notice performed by either party. The terms of this Agreement shall remain in force unless mutually amended in writing." 4. All other terms and conditions of said Services Agreement is unchanged and shall remain in full force and effect. Attached are one (1) original agreement and two (2) duplicate original agreements. Please obtain signatures in the appropriate locations and return the ORIGINAL contract to the City Clerk's Office as soon as possible, to Dodie Otterbein. Please retain one duplicate agreement for your records and forward the remaining fully executed copy to the other party. Please be advised that the contract will be null and void if not executed within 120 days from the date of adoption, or returned to our office by December 5, 2006.
