Staff Report
Subiect:
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
Director of the Parks, Recreation and Community Services Department to execute an
amendment to an Agreement with the San Bernardino City Unified School District to extend the
term of the Agreement from July I, 2006 through September 30, 2006, to provide contractual
services for seventeen (17) CAPS before & after-school recreation programs at school district
sites.
Back2round:
The Children's After-School Program for Success (CAP.S.) is a grant funded program
administered by the San Bernardino City Unified School District to provide before & after-
school programs at school sites. The city has been a sub-contractor to the school district in this
program since 1999. Each school site provides teachers and aides to teach educational and
tutorial programs. The Parks, Recreation and Community Services Department provides arts and
crafts, as well as other recreational activities.
In March of 2006, an Memorandum of Understanding (MOU) with a description of in-kind
services that the City would provide to the District was included in the District's application for
State and Federal CAPS program funding. The purpose of the MOU was to specify the
parameters under which the City of San Bernardino agrees to provide contractual services to the
San Bernardino City Unified School District for seventeen (17) before & after-school sites for a
period beginning July 1,2006 through June 30, 2007.
The District was late in getting the new agreement to the City Council for approval. The City
received the contract on June 20, 2006. In the proposed agreement new insurance requirements
were added making it necessary for the City to allow more time for City Attorney's review.
Therefore, the District has requested a 90 day extension of the original agreement ending
June 30, 2006. The 90 day extension will cover July 1,2006 through September 30, 2006. This
extension will allow time for the District to prepare a new agreement with the insurance
requirements and time for the City Attorney to review these requirements.
The 90 day Agreement would include a $110,494 payment to the City for its services

The City will be reimbursed in the amount of$110,494 for services provided during the 90-day
extension.

BE IT RESOLVED BY THE MAYOR AND CO;\-IMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Director of the Parks, Recreation and Community Services
Department of the City of San Bernardino is hereby authorized and directed to execute an
Amendment to an Agreement with the San Bernardino City Unified School District to extend the
term of the Agreement to provide contractual services for seventeen (17) CAPS before & after-
school recreation programs at school district sites. This Amendment to the Agreement covers the
dates July I through September 30, 2006. A copy of said Amendment to the Agreement is
hereby attached hereto, marked Exhibit "A", and incorporated herein by reference as fully as
though set forth at length.
SECTION 2. The authorization granted hereunder shall expire and be void and of no
further effect if the agreement is not executed by both parties and returned to the Office of the
City Clerk within 120 days following the effective date of the Resolution.

compensate the CONSULTANT for services rendered in a total amount not to exceed
5110,494.00 (One Hundred Ten Thousand Four Hundred Ninety-Four Dollars and

Any prior Amendment to this Agreement is hereby revoked to the extent it is inconsistent

RECITALS
WHEREAS, the DISTRICT is authorized by Section 53060 of the California Government Code
to contract'with and employ any persons for the furnishing of special services and advice in
financial, economic, accounting, engineering, legal, or administrative matters, ifsuch persons are
specially trained and experienced and competent to perform the special services required; and,
WHEREAS, the CONSULTANT itself is, or those hired by the CONSULTANT are, specially
trained, experienced and competent to render the special services required by the DISTRICT,
and such services are needed on a limited basis; and,
NOW, THEREFORE, in consideration of the covenants and conditions hereinafter set forth, the
DISTRICT and the CONSULTANT mutually agree to amend this ah'l'eement as follows:
I. CHANGES TO THE AGREEMENT:
