Description) Finance: Council Notes: Rf~D . d-OO~-lt:1 Agenda Item No. 1/ ~ - 7- 0 b CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION a Staff Report _ SUBJECT: Authorization to Proceed and Resolution determining fair market value and setting a public hearing relative to the sale of a portion of City owned real property located generally northeasterly of Scenic Drive, easterly of Valley View Drive for the widening of the 1-215 Freeway. BACKGROUND: In April, 2006, this office was notified by the State of California Department of Transportation (Caltrans) of its intent to purchase a portion of City owned property generally located easterly of Scenic Drive, easterly of Valley View Drive. The purpose of the acquisition is to facilitate the proposed widening project of the 1-215 freeway, which will help reduce some of the freeway congestion in this area. The property being proposed for acquisition is part of a larger parcel of City owned property that is being used as an open space I passive park area located along Scenic Drive, as depicted on the attached map. In addition to acquiring a portion of this parcel, Caltrans is also requesting a temporary construction easement for a period of 55 months. The fee acquisition area consists of 184 square feet and the temporary easement and access control area consists of 4,251 square feet. Recently, we were presented with an offer from Caltrans, in the amount of $10,400 for the fee acquisition and the temporary easements. They also submitted an appraisal of the proposed acquisition. Staff has reviewed the appraisal and concurs with the value and supporting data. The offer also includes a the costs of certain improvements consisting of chain link fencing, irrigation components and _ landscaping. A summary of the offer is as follows: $ 305.44 $ 5,560.00 $ 4,418.51 $ 10,373.95 $ 10,400.00 Upon completion of the project, the area within the temporary construction easement will be restored to its prior condition. The Parks, Recreation and Community Services Department has indicated that they do not have any conflicts with the proposal. Section 2.65.030 of the City's Municipal Code allows City property valued at under $25,000 to be sold without the competitive bid process, so long as the property is sold at fair market value. The attached resolution establishes the fair market value of $10,400 for the property, improvements, and temporary easements, and sets a public hearing for September 5, 2006. A resolution authorizing the sale and execution of a right of way contract with the State of California will be submitted at that time for your consideration. RESOLUTION OF THE CITY OF SAN BERc"lARDINO ESTABLlSHIC'iG AND SETTING A FAIR MARKET VALUE AND SALES PRICE OF $10,400.00 AND DECLARING THE INTENTION OF THE CITY TO SELL A PORTION OF CITY 5 OWNED PROPERTY GENERALLY LOCATED NORTHEASTERLY OF SCENIC DRIVE, EASTERLY OF VALLEY VIEW DRIVE, TO THE STATE OF CALlFORc"lIA 6 RELATIVE TO THE WIDENING OFTHE 1-215 FREEWAY AND SETTING A PUBLIC HEARING TO CONSIDER SAID SALE. 7 8 4 WHEREAS, the City of San Bernardino, a municipal corporation, is the owner of the 9 10 11 12 13 14 hereinafter described parcel of real property, generally located northeasterly of Scenic Drive, easterly of Valley View Drive, in the City of San Bernardino, State of California, more fully described as follows: Lot 23, Block I Scenic Knoll, Tract No. 1963, in the City of San Bernardino, County of San Bernardino, State of California, as per plat recorded in Book 28 of Maps, page 52, records of said County; and 15 16 t 7 parcel relative the widening of the 1-215 Freeway, more fully described in Exhibit "A", attached 18 19 WHEREAS, the State of California desires to acquire a portion of said City owned hereto and made a part hereof, together with a temporary construction and access easement, more fully described in Exhibit "B" attached hereto and made a part hereof; and WHEREAS, the Mayor and Common Council of said City believe it is in the best interest of the City that said parcel of real property be sold to the State of California to facilitate the widening of the 1-215 Freeway; and WHEREAS, the State of California has presented the City with an appraisal summary indicating a fair market value of Ten Thousand Four Hundred Dollars ($10,400) for said real property, including improvements consisting of landscaping and appurtenant irrigation, and a temporary construction and access easement; and 08/02/06 '1\.0. The public interest and convenience require the sale of a portion of City 19 fully described in said Exhibit "A", and same is hereby declared as surplus real property. SECTION 2. It is therefore the intention of the Mayor and Common Council of the City of San Bernardino to sell said real property to the State of California. SECTION 3. The Mayor and Common Council do hereby find and determine that the Fair Market Value and sales price of said real property is Ten Thousand Four Hundred Dollars ($10,400.00), including improvements consisting of landscaping and appurtenant irrigation, and temporary construction and access easements, as described in said Exhibit "B". SECTION 4.
