Staff Report
SUBJECT:
Resolution of the City of San Bernardino authorizing execution of a Standard Contract
Agreement for services with Los Padrinos Youth Services, Inc. for the Summer Youth Work
Program.
BACKGROUND:
On June 29, 2006, the Mayor and Common Council approved an allocation of$180,000 for the
"Safe Summer For Youth Initiative" as part of the FY 2006-2007 Adopted Budget. On July 24,
2006, the Mayor and Common Council approved the budget transfer of $180,000 to various
Parks & Recreation and Code Compliance accounts for these programs. This amount included
$70,000 for a contract with Los Padrinos Youth Services, Inc. to hire at-risk youth for the
Mayor's Youth Initiative program; $35,000 to be paid by the City and $35,000 to be reimbursed
to the City by EDA. Also approved at the Council meeting of July 24, 2006, was an additional
$34,000 from the Mayor's Youth Initiative Program to be used to expand the operating days and
hours during the summer for youth programs at Delmann Heights Community Center and the
Boys and Girls Club.
At this time, staff is requesting that authorization to execute a Standard Contract Agreement be
given to include a Summer Youth Work Program for 40 to 50 youth in the amount of $70,000.
The addition of this program is necessary to perform much needed services throughout the City
and to offer at -risk youth the opportunity to work during the summer. The contract with Los
Padrinos is to hire approximately 40 to 50 at-risk youth to work on clean-up initiatives in
neighborhoods throughout the City. Los Padrinos' program includes voluntary drug testing,
monitoring, and job skill training.
A draft copy of the Safe Summer for Youth Initiatives and the proposal submitted by Los
Padrinos outlining the program is attached for your reference. .
FINANCIAL IMPACT:
If approved, $35,000 shall be paid through the General Fund and $35,000 shall be paid through
CDBG funds.
RECOMMENDATION:
Adopt resolution.

Safe Summer for Youth Initiatives

. Provide free pool admission for vouth
Investment: $35,000 ($20,000 in reduced pool fee revenues; $15,000 for
additional contract with the Boys and Girls Club)
Allow free use of most pools for local youth and actively market pool use through
non-profit, church and government youth serving organizations. Free pools will
include the Delmann Heights pool operated by the Boys and Girls Club. (Note:
Jerry Lewis Swim Center fees will remain unchanged.)
. Open an additional public pool site at Western Reldonal Little Leal!ue
Investment: $10,000 (additional part-time salaries for staffing)
Add this facility for free use by youth. Opening of the site is contingent upon
hiring sufficient lifeguard/pool management staff.
. Expand pool operatinl! bours
Investment: $7,000 (additional part-time salaries for staffing)

All pools would be open 7 days per week, until 7:00 p..m. This is contingent upon
hiring sufficient lifeguard staff.
. Create new" Afterschool at School" recreation sites
Investment: $35,000 (additional part-time salaries for staffing)
In partnership with San Bernardino Unified School District, provide free,
supervised recreation activities including leagues, tournaments, music etc. at four
middle school sites from 4pm to 8pm July through September IS. Program would
utilize middle school multipurpose rooms and outdoor facilities.
. Open Community Centers for weekend activities
Investment: $20,000 ($16,000 in additional part-time salaries for staffing;
$4,000 in additional payments to the Boys and Girls Club)
The City's Community Center operations would be expanded to 7 days per week
throughout the summer.
. Create a new "Camp San Bernardino" (weekend resident camp)
Investment: $23,000 (part-time salaries; camp facility fees and associated
costs)

The City would send 25 at-risk, low income participants on 5 weekend camping
trips throughout the summer (total of 125 participants). Youth would work on

social skills, problem solving, and anger management while promoting beliefs
that are favorable to non-violence. Activities such as confidence courses will be
utilized.
. Beein work on a Police Athletic Leaeue (PAL) at the Delmann Heiehts
Community Center
Investment: $15,000 (contract with the Boys and Girls Club for start-up costs;
once in place, the program will cost approximately $60,000 annually)
. Hire at-risk vouth to take part in city clean-up initiatives
Investment: $70,000 (contract with Los Padrinos Youth Services; $35,000 from
EDA and $35,000 from City's General Fund)
Los Padrinos will hire approximately 80 at-risk youth to work on clean-up
initiatives in neighborhoods throughout the City. Los Padrinos' program includes
voluntary drug testing, mentoring, and job skill training.
. Provide vouth iob trainine and development opportunities throueh the San
Bernardino Emplovment and Trainine Aeencv (SBET A)
. Investment: Existing Workforce Investment Act (WIA) funds

50 WIA eligible youth will participate in an I I -day
residentialleadership/skills development program at the University of
Redlands. The program provides tutoring, paid work experience, leadership
development and guidance and counseling.
Approximately 25 WIA eligible youth will participate in programs
through the ASA Learning Center and the San Bernardino Regional
Occupation Program (RaP) that provides alternative secondary school
services, occupational skills training, tutoring, paid/unpaid work experience,
leadership development, and guidance and counseling.

I) Crew Supervision:
All hired youth related to operation Phoenix will be added to our existing
crews and under the direct supervision of our existing and experienced
youth leaders.
2) Work Hours:

Crews will be divided equally into two work schedules-Twenty hours each
week 112 of the crew will be working full time Monday and Tuesday and
112 day of Wednesday. The other 1/2 of the crew will he working 112
day on Wednesday and full time Thursday and Friday. .
3) Youth employed to date:
Currently we have twenty live (25) youth employed and there arc twenty
six (26) other youth working on their school work permits. etc.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING
EXECUTION OF A STANDARD CONTRACT AGREEMENT WITH LOS
PADRINOS, YOUTH SERVICES INC., A NON-PROFIT
ORGANIZATION.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and
directed to execute, on behalf of said City, a Standard Contract Agreement with
LOS PADRINOS, INC., a non-profit organization, a copy of which is attached
hereto and incorporated herein by this reference.
SECTION 2. The authorization to execute the above referenced agreement is
rescinded if the parties to the agreement fail to execute it within sixty (60) days of
the passage of this resolution.

ST ANDARD CONTRACT AGREEMENT
THE EFFECTIVE DATE OF THIS AGREEMENT is the day
of ,2006 between LOS PADRINOS YOUTH SERVICES, INC.
("CONTRACTOR") and the CITY OF SAN BERNARDINO ("CITY").
WITNESSETH:
WHEREAS, CITY has need for graffiti. weed. debris removaL abatement services and
assistance to senior or disabled residences within the CITY and,
WHEREAS, CONTRACTOR is competent, experienced and able to perform
said services;
NOW THEREFORE, the parties hereto agree as follows:
The purpose of this Agreement is to put into effect a Summer Youth Work Program
through Los Padrinos Youth Services, Inc., to employ approximately forty (40) youth to perform
work in conjunction with clean-up initiatives in neighborhoods throughout the City. The Summer
Youth Work Program shall include voluntary drug testing, mentoring and job skill training.
2) Recruitment for forty (40) youth to be employed by CONTRACTOR shall begin upon
the execution by both parties of this Agreement. These youth shall be employed for twenty (20)
hours each week, half to work full time on Mondays and Tuesdays and half day on Wednesdays.
The other half of the employed youth shall work half day on Wednesdays and full time on Thursdays
and Fridays.
3) Over the term of this Agreement, CONTRACTOR shall be paid $70,000 for
such services. As the length of the Summer Youth Work Program is nine (9) weeks, payment shall
be made in full upon execution of this Agreement.
4) The term oflhis Agreement shall begin from the date this Agreement is fully executed by
both parties and shall continue for a total of nine (9) weeks. It may be canceled by thirty (30) days
written notice by either party. The Mayor, or his designee, is authorized to extend this Agreement

for up to thirty (30) days and approve line item adjustments to the Agreement's program budget as
long as any such extension is upon the same ternlS and conditions as specified herein.
5) By mutual agreement between the City of San Bernardino and CONTRACTOR
this Agreement does not replace any previous service contracts or agreements between the City of
San Bernardino, the San Bernardino Economic Development Agency and said CONTRACTOR but
shall be considered in addition to any existing service contracts or agreements for related services.
6) CONTRACTOR shall indemnify, defend and hold CITY, its officers, employees and
agents harmless from any claim, demand, liability, suit, judgment of expenses (including, without
limitation, reasonable costs of defense and legal fees) arising out of or related to CONTRACTOR'S
performance of this Agreement, except that such duty to indemnify, defend and hold harmless shall
not apply where injury to person or property is caused by CITY'S willful misconduct or sole
negligence.
CONTRACTOR shall hold harmless the City, its elective and appointive boards,
commissions, officers, officials, attorneys, employees and agents from any liability for damage or
claims for damage for personal injury, including death, as well as from claims for property damage,
expense, including defense costs and legal fees, which may arise from Contractor's operations under
this agreement, whether such operations be by Contractor or by anyone or more persons directly or
indirectly employed by or acting as agent for Contractor. Contractor shall defend (upon request by
City), the City and its elective and appointive boards, commissions, officers, officials, attorneys,
employees and agents from any suits or actions at law or in equity for damages caused, or alleged to
have been caused, by reason of any of Contractor's operations, The costs, salary and expenses of the
City Attorney and members of his office in enforcing this Contractual Agreement on behalf of the
City shall be considered as "defense costs and legal fees" for the purposes of this paragraph.
7) While not restricting or limiting the foregoing, during the term of this
Agreement, CONTRACTOR shall maintain in effect policies of comprehensive public,
general and automobile liability insurance, in the amount of $2,000,000.00, per

occurrence combined single limit, naming the City of San Bernardino as additional named insured.
CONTRACTOR shall also maintain statuto!)' worker's compensation coverage, and shall file copies
of said policies with the CITY'S Risk Manager prior to undertaking any work under this Agreement.
City shall be given thirty (30) days written notice if the insurance is canceled or substantially altered.
8) CONTRACTOR shall perform work tasks as directed by the Code Enforcement
Director but for all intents and purposes, CONTRACTOR shall be an independent contractor and not
an agent or employee of the CITY.
9) In the performance of this Agreement and in the hiring and recruitment of the
employees, CONTRACTOR shall not discriminate on the basis of race, creed, color,
religion, sex, physical handicap, ethnic background or count!)' of origin.
10) Any notice to be given pursuant to this Agreement shall be deposited with the
United States Postal Services, postage prepaid and addressed as follows:

this Agreement, it shall first obtain a Business Registration Certificate from the City
Clerk and shall keep such Certificate current during the term of this Agreement.
