U'm~ -II ):2 Agenda Item ~ ~;).5/ I ) D {fD3 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subject: An Ordinance of the City of San Bernardino amending Section 12.68.020A of the San Bernardino Municipal Code relating to hours of use of public parks. Background: Currently, the San Bernardino Municipal Code 12.68.020A reads as follows: "It is unlawful for any person to be or remain in any public park between the hours often p.m. of any day to six a.m. of the next succeeding day except upon written approval of the Director of Parks, Recreation and Community Services or the Mayor or Common Council." Over the past year there have been a number of incidents within city parks after closing hours that have prompted concern among city officials, department staff and city contractors. These incidents have included shootings, assaults, littering, vandalism and camping. As a result of an apparent increase in these incidents, the police department significantly increased enforcement of the current park hours ordinance. Additionally, officials from the Mayor's office, Parks, Recreation and Community Services Department, Police Department, Code Enforcement and the Attorney's office met to discuss strategies to mitigate this trend. One firm recommendation out of this effort is to develop park hours more consistent with the time of sunset, without hampering the use of lighted park activity areas. There are (3) primary motivations for this request: (1) The police patrol division commander believes that the patrol officers can more safely enforce the new ordinance hours with a minimum level of sunset lighting. The current ordinance hours require enforcement in absence of sun light. (2) If enforcement of park hours can begin earlier, it is less likely that violators will return later in the evening. (3) There is not a safe and legitimate reason for the public to be with in a park facility that does not have activity lighting. This ordinance change will have no impact on youth sports, adult sports, walking/jogging or any other lighted or permitted activity within park facilities. Financial Impact: Estimated cost of $2,000 ($10 x 200 signs) to update existing posted ordinance signs at all park facilities. Recommendation: That said ordinance be laid over for final adoption and referred to the Legislative Review Committee. Memorandum TO: Fred Wilson - City Administrator Lemuel P ~arks, Recreation and Community Services Director October 1, 2003 FROM: DATE: RE: Legislative Review Committee review of Park Hours Ordinance Change On September 23 the Legislative Review Committee met to discuss the Park Ordinance Hours change that passed the first reading on September 15 at City Council. There were questions relative to the ability of citizens to acquire permits for use of the parks after closing hours. Staff stated that currently groups of fewer than 25 are not required to have a permit however any size group seeking use of the parks extending past the park hours would require a permit. There were no further comments or concerns regarding the ordinance change. San Bernardino Municipal Code Section 12.68.020A is amended to now read 7 in its entirety as follows: 8 nA. 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 11/ 26 11/ 27 11/ 28 /11 During the months of January, February, March, October, November, and December of each and every year, it is unlawful for any person to be or remain in any public park between the hours of six p.m. (6:00 p.m.) of any day to six a.m. (6:00 a.m.) of the succeeding day except upon written approval of the Director of Parks, Recreation and Community Services or the Mayor and Common Council. During the months of April, May, June, July, August, and September of each and every year, it is unlawful for any person to be or remain in any public park between the hours of eight p.m. (8:00 p.m.) ofany day to six a.m. (6:00 a.m.) ofthe succeeding day except upon written approval of the Director of Parks, Recreation and Community Services or the Mayor and Common Council. Notwithstanding the provisions of the first two sentences herein, person(s) who are utilizing the lighted activity portions of the public park for those intended lighted activities (including the time necessary to go to and from the intended lighted activities), when no such written approval is required for such intended lighted activities, may remain in the public park until the hour often p.m. (10:00 p.m.), but thereafter it is unlawful for any such person(s) to be or remain in any public park between the hours often p.m. (10:00 p.m.) of any day to six a.m. (6:00 a.m.) of the succeeding day."
