J..~ 7J~L{JD(P e e e CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Resolution authorizing agreement between the City of San Bernardino and Little League Baseball, Inc. for civic and promotion funding in the amount of$5,000 from the FY 06/07 budget to assist with the conduct of their Western Regional tournament on August 4-13,2006. The organization is also requesting a waiver of applicable departmental fees in connection with the event. BACKGROUND: James Gerstenslager, Western Regional Director, is requesting financial assistance from the FY 06/07 civic and promotion fund in the amount of$5,000 to aid in the conduct of their 2006 tournament scheduled for August 4-13, 2006. They are also requesting a waiver offees for department personnel and equipment connected with the event. These fees are as follows: Police Parks/Rec Public Services City Manager's Office $32,000 1,900 4,900 400 TOTAL $ 39,200 Attached is a letter to the City dated June 28, 2006 and a completed Request for Funding Assistance including a proposed budget and anticipated revenue from other sources, for your reVIew. Last year, the Mayor and Council approved $5,000 in civic and promotion funding to support the activity with a similar waiver offees. Staff has reviewed the accounting submitted in accordance with the agreement and found it to be acceptable. FINANCIAL IMPACT: Included in the FY06/07 budget is $153,500 (Acct. #001-091-5186) in civic and promotion funds which are traditionally used to support events of common interest to the community. Attached is a matrix illustrating FY05106 funding activity. RECOMMENDATION: 1. Adopt resolution. 2. Twelve Championship teams from the II states of the Little League Western Region will begin arriving on Wednesday, August 2, 2006. In past years, we have greatly appreciated the financial support from the San Bernardino City Council. The financial support will again help defray the cost of the tournament. I am respectfully requesting a grant of $5,000.00 for our 2006 event. These funds will be used to offset costs associated with transporting teams to and from the airport in rented buses and serving approximately 9000 meals for teams and volunteers for the 10 day event. Each year more that 200 players, managers and coaches come to San Bernardino to compete for the opportunity to advance to the Little League Baseball World Series in Williamsport, PA. We will again be sending two representatives from the Western Region. Both championship games will be televised live on ESPN2 from Al Houghton Stadium here at the Western Regional Headquarters. The West Division Championship will be televised on August 12th and the Northwest Division Championship will be televised live on August 13th. We again anticipate between 50 and 60 thousand visitors from throughout the eleven Western Region States. Their return is testimony to the warm family welcome they receive from the City of San Bernardino. We sincerely thank the City Council for the outstanding support we have received in the past and hope that you will look favorably on this request. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING AN AGREEMENT WITH THE CITY OF SAN BERNARDINO AND WESTERN REGIONAL LITTLE LEAGUE BASEBALL FOR FINANCIAL ASSISTANCE FROM THE CIVIC AND PROMOTION FUND FOR FY 2006/07. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said City an Agreement with San Bernardino Western Regional Little League Baseball, Inc., for civic and promotion funding in the amount of $5,000 in direct funding from the FY 2006/07 Budget, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. Section 2. Expenditure of indirect funding in the amount of $39,176 is further authorized to be transferred from the civic and promotion fund to various general fund departmental accounts as noted in the staff report included as Attachment "B". Section 2. The expenditure is for a valid municipal public purpose, to wit: for the conduct of events related to their annual Little League baseball tournament. 2. Payment. Use of Funds. The funds paid on behalf of Organization shall be used solely for the purposes set forth in Paragraph 1 above. No deviation from these provisions shall be made without the express approval of the City of San Bernardino. Any unexpended funds shall be returned to the 7 8 City by Organization. 9 10 4. Accountability. Financial records shall be maintained in accordance with generally 11 accepted accounting principles by Organization for this event in such manner as to permit City to 12 easily trace the expenditure of the funds. All books and records of Organization for this event 13 14 are to be kept open for inspection at any time during the business day by the City or its officers 15 or agents. Failure to submit the financial records in accordance with this section will result in the 16 Organization reimbursing the City in the full amount received by Organization. At the 17 18 19 conclusion of the program, Organization or its designee shall present the City Administrator or his designee copies of all receipts for expenditures connected with said program in the total amount of FIVE THOUSAND DOLLARS ($5,000). 20 21 22 5. Hold Harmless. Organization covenants and agrees to defend, (if requested by City), indemnify, and hold 23 harmless the City, its departments, agencies, boards, commissions, elected officials, officers, 24 attorneys, employees and agents from all liabilities and charges, expenses (including counsel 25 26 27 28 fees), suits, or losses, however occurring, or damages arising or growing out of the use or receipt of the funds paid hereunder and all operations under this Agreement. The costs, salary and expenses of the City Attorney and members of e e 4 his office in enforcing this Agreement on behalf of the City shall be considered as "counsel fees" 5 for the purposes of this paragraph. 6 7 8 6. Insurance. While not restricting or limiting the foregoing, during the term of this 9 Agreement, Organization shall maintain in effect policies of comprehensive public, general and 10 automobile liability insurance, in the amount of $1 ,000,000, per occurrence combined single 11 limit, naming the City of San Bernardino, its departments, agencies, boards, commissions, 12 elected officials, officers, attorneys, employees, and agents as additionally insured. A certificate 13 14 of insurance evidencing such coverage shall be provided to the Mayor or her designee, with the added notation that the insurance policy shall not be terminated or materially altered without 10 15 16 days prior written notice to the City. 17 18 19 7. Termination. City shall have the right to terminate this Agreement and any funding remaining unpaid hereunder at its sole discretion by mailing a ten-day written notice to 20 Organization and this Agreement shall terminate ten days after the mailing of such notice.
