In early 2005, SANBAG staff received a request from the Inland Valley Development Association (NDA)
to provide an opinion on the feasibility of placing a new freeway interchange at Victoria Avenue on the
existing State Route 210 freeway in the City of Highland. At the time, the IVDA was considering relocating
passenger terminal facilities for San Bernardino International Airport (SBIA) to a location near the southern
terminus of Victoria Avenue and was interested in freeway accessibility. As a courtesy, SANBAG staff
performed a "windshield" survey of the location. Staffs preliminary conclusion conveyed to NDA was that
because of the existing bridge at this location and adjacent underutilized land uses, the potential exists for the
development of a new interchange at this location but that a more in-depth analysis would need to take place
to confirm the initial conclusions.
With these preliminary results in mind and the NDA's decision to relocate the passenger terminal facilities
of SBIA, the NDA formally requested that the City of Highland consider including a new interchange at this
location as part of the Circulation Element of the its General Plan Update. Highland agreed and has included
~ new interchange at this location. The next step in the process to determine how to proceed is the
w:evelopment of a Project Study Report (PSR). In July 2005, Highland requested that SANBAG host a
meeting of affected jurisdictions to ascertain the interest of initiating a PSR and a willingness to participate
in funding the study. The jurisdictions involved include Highland, San Bernardino, the County of San
Bernardino, the San Manuel Band of Mission Indians and the NDA. In September, representatives from the
five entities verbally agreed to seek direction from their respective governing boards on whether to
participate financially in the PSR. Also at this meeting, it was agreed by the five participating agencies that
Highland would request that SANBAG act as a lead agency for the PSR development. The level of effort that
SANBAG would provide is minimal and would involve selection of a consultant to prepare the PSR and
coordinate occasional project development team meetings.
The attached Cooperative Agreement (No. 06-057), last revised on AprilS, 2006, is a six-party agreement in
which SANBAG agrees to assist the PSR effort by contracting with a consultant and coordinating meetings.
The other five parties listed above agree to share in the cost of the consultant effort and shall n,imburse
SANBAG for all cost incurred for that effort and have representatives from the respective agencies
participate in PSR activities. This Agreement will only become effective upon execution by all six parties to
the Agreement.
The IVDA has approved the Agreement. The City of Highland City Council approved the Agreement at the
May 23, 2006 City Council meeting. The County of San Bernardino will take the Agreement to the Board of
Supervisors when the signed Agreement is transmitted to them. The San Manuel Band of Mission Indians is
committed to signing the Agreement when the other four parties have signed and obtained conditional
approval from tribal council on June 13, 2006.
-After meeting with the Mayor on June 26, 2006, SANBAG agreed to modify the scope of the study to
include operational improvements to the existing interchange at Highland Avenue and Arden Avenue as an
alternate to constructing a new interchange at Victoria Avenue.

The City's estimated share of the cost is $50,000. Funds will be included in the 2006-07 CIP. A project
number has not been assigned yet.
Recommendations:

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO APPROVING A COOPERATIVE AGREEMENT BETWEEN
THE SAN BERNARDINO COUNTY TRANSPORTATION AUTHORITY, THE
INLAND VALLEY DEVELOPMENT AGENCY (IVDA), THE COUNTY OF SAN
BERNARDINO, THE CITIES OF SAN BERNARDINO AND HIGHLAND, AND THE
SAN MANUEL BAND OF MISSION INDIANS, FOR THE PREPARATION OF A
PROJECT STUDY REPORT (PSR) FOR STATE ROUTE 210 - ARDEN-HIGHLAND
AND VICTORIA AVENUE INTERCHANGES (SS07-24).
WHEREAS, it is in the interest of the cities of San Bernardino and Highland, the
County of San Bernardino, the San Manuel Band of Mission Indians, the Inland Valley
Development Agency (IVDA), and the San Bernardino Associated Governments (SANBAG)
to determine whether traffic circulation may be improved in the northeastern region of the San
Bernardino Valley by studying the potential of modifying or replacing the existing Highland
Avenue Interchange at SR30 (future SR 210) with a new Victoria Avenue Interchange; and
WHEREAS, a Cooperative Agreement between the six above-named entities has been
prepared for the purpose of contracting with a consultant to prepare a Project Study Report
(PSR) for State Route 210 - Arden-Highland and Victoria Avenue Interch~ges.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
That the Mayor is hereby authorized to execute Cooperative
Agreement No. 06-057 between the San Bernardino Associated Governments and the County
of San Bernardino, the cities of San Bernardino and Highland, the San Manuel Band of Mission
Indians, and the Inland Valley Development Agency, which is attached hereto (see Attachment
"A") and incorporated herein. Such Cooperative Agreement shall be effective only upon being
fully executed by all parties.
SECTION 2.
That the authorization to execute the above-referenced
Cooperative Agreement is rescinded if it is not executed by all of the parties within one
hundred and twenty (120) days of the passage of this Resolution.

COOPERATIVE AGREEMENT NO. 06-057
BETWEEN
SAN BERNARDINO COUNTY TRANSPORTATION AUTHORITY
AND
COUNTY OF SAN BERNARDINO, CITIES OF SAN BERNARDINO AND HIGHLAND,
SAN MANUEL BAND OF MISSION INDIANS, AND THE INLAND VALLEY
DEVELOPMENT AGENCY (IVDA)
This Agreement is between the San Bernardino County Transportation Authority (hereinafter
"AUTHORITY") and the County of San Bernardino, Cities of San Bernardino and Highland, San
Manuel Band of Mission Indians, a federally recognized Indian Tribe, and the Inland Valley
Development Agency (IVDA) (hereinafter "ENTITIES").
RECITALS
I. In the interest of potentially improving traffic circulation and to facilitate economic growth
in the northeastern region of the San Bernardino Valley, ENTITIES desire studying the
potential of modifying or replacing existing Highland Avenue Interchange at SR 30 (future
SR 210) with a new Victoria Avenue Interchange, hereinafter referred to as "PROJECT".
2. The PROJECT is located in the City of Highland in the County of San Bernardino.
3. ENTITIES have requested that AUTHORITY act as lead agency for preparing a Project
Study Report (PSR) for the PROJECT.
4. ENTITIES agree to equitably share in the cost of the PSR at no cost to AUTHORITY.
5. AUTHORITY shall provide PSR facilitation services to include inviting Statements of
Qualifications from consultants, subsequently award a contract to the selected consultant to
prepare the PSR in an amount estimated to not exceed $250,000 and convene meetings to
include representatives from all ENTITIES.
AGREEMENT
I. This Agreement shall only take effect upon execution by all parties to this agreement.
2. AUTHORITY shall assume the role of lead agency to issue a Request for Qualifications
(RFQ) for consultant services to prepare a Project Study Report (PSR) for the PROJECT.
AUTHORITY will subsequently select and engage the services of a consultant and oversee
the process of preparation of the PSR.
3. AUTHORITY will provide lead agency services at no cost to the ENTITIES.
4. Besides the costs of project management services, all costs related to and including

preparation of the PSR for the PROJECT including any changes in the scope, character or
total cost of the PSR are the sole responsibility of the ENTITIES. In order to fund such costs
each ENTITY shall deposit a not to exceed amount of $50,000 with the AUTHORITY. If,
upon completing negotiations with the selected consultant, the AUTHORITY determines that
the PSR shall exceed $250,000, the AUTHORITY shall convene a meeting of representatives
from the ENTITIES to address costs that exceed the $250,000 estimate prior to awarding a
professional services contract to the selected consultant.
5. AUTHORITY shall make payments to consultant in accordance with the invoices as work
is completed. Properly submitted and documented invoices shall be paid within thirty (30)
days after receipt by AUTHORITY.
6. Upon completion of work performed by consultant and payment of a final invoice the
AUTHORITY shall refund to each ENTITY in equal shares any balances that may remain
from the initially deposited funds.
7. This Agreement sets forth the complete understanding between the parties and no other
representations or understandings shall govern the relationship between the parties.

I am responding to your previous memorandum of October 3, 2005
, advocating the funding of a project study report (PSR) for the proposed
Victoria Interchange,

First. I must restate my objections, which were not addressed in your
memorandum, regarding the usefulness of the proposed interchange to
the expansion of Alliance California (formerly Norton Air Force Base). This
proposed interchange has no useful purpose for this project! Victoria is
and will remain a residential street that is not conducive for the heavy
truck travel that would predicate the interchange's ability to service
Alliance California for either Cargo or Passenger movement. The very
concept that San Bernardino International Airport will ever provide
significant passenger service is absurd on its face. (I know this is not your
assumption Mr, Wilson.) The airport is simply too close to the ever-
expanding passenger service available at Ontario International Airport.

As noted in my previous memorandum, the proposed interchange has no
net positive impact on traffic within the City of San Bernardino and in fact
will likely produce a negative result, both for the community and the City
treasury. The two solutions supplied in your memorandum are not only
unlikely, but also somewhat dangerous.

1. Keeping the Arden/Highland interchange and building the
Victoria interchange creates a significant traffic danger to
freeway motorists, as they would be within 1/3rd of a mile,
Additionally, the proposed use for the Victoria interchange as a
cargo-moving corridor would require the ingress and egress of
heavily loaded trucks incapable of reaching the proper merging
speed in such a short distance. This fact, in combination with
the close proximity of the Arden/Highland lnterchange creates a
significant threat to public safety.

2. A frontage road assumes the available space and property to
build it and does not address the fact that traffic would still be
diverted away from the Soccer Complex and the business
corridor on Highland. Additionally, it would likely create its own
traffic problems due to the angle that the 30 freeway crosses San
Bernardino in this area.

As you stated in your memorandum, the City Engineer feels that it is
important for San Bernardino to participate financially in the PSR as it
gets us a 'seat at the table'. This falsely assumes that Sa.'1. Bernardino will
somehow be left out of the project if we do not help fund it. I took the
liberty of contacting Darren Kettle, Director of Freeway Construction
for SANBAG, and he stated that San Bernardino's participation in
both the PSR and potential future processes such as EIR's would "not
be affected by our lack of financial support for the PSR." This project
. cannot move forward without the City of San Bernardino whether or not
we finance it. Additionally, it is highly unlikely that the project could ever
be built without San Bernardino's official support. Therefore the
expenditure of taxpayer funds ($50,000 proposed) is completely
unnecessary for our participation. I know of a great many potholes that
we could fill or half of an additional police officer position we could fund.
The expenditure of any City Funds for a project that is unnecessary,
unlikely ever to be built, fails to address the issues it is purported to fix,
and that would negatively affect our community is a foolish idea.

I am responding to your September 21,2005 memorandum expressing concerns
about the inclusion of the Victoria Interchange in the SANBAG Nexus Study.

The Nexus Study, a requirement of the Measure I extension approved by voters in
November 2004, includes local arterials, freeway interchange and grade separation
improvements to the regional transportation network. It requires a fair share
contribution from developers to mitigate the traffic impacts new development will
have on the regional network. The inclusion of the Victoria Avenue interchange
was requested by the City of Highland for regional reasons along with IVDA/SBIAA
who see this interchange as a vital link to the long term development of the base for
passenger/cargo use.
Before any decisions can he made on the need for this interchange, a project study
report (PSR) must first be completed. The City of Highland has requested that the
City of San Bernardino, County of San Bernardino, IVDA and the San Manuel
Indian Tribe equally participate in the cost of preparing the PSR, the flTSt step in
identifying potential alternatives to constructing an interchange along State Route
210 at Victoria Avenue. SANBAG will also be requested to manage preparation of
the PSR
Therefore, until a PSR is completed and all the implications carefully addressed and
understood, the Victoria Avenue/State Route 210 interchange will not be a part of
the development fee Structure for the City of San Bernardino.

Our City Engineer feels that it is important that the City of San Bernardino
participate in the cost of the PSR so we will have an equal part in the development
of the document that will be used to conduct environmental studies and determine a
preferred project alternate. Some of the alternates include keeping the two exit

ramps at the Highland/Arden interchange as part of the project to provide access
from the freeway to businesses in San Bernardino along Highland Avenne and
Soccer Complex. Another possibility could be to provide a frontage road connection
between Victoria Avenue and Highland Avenue to restore the connection to
Highland Avenue, should the interchange be moved in its entirety. In any case, the
City of San Bernardino should be at the table to make sure our interests are
represented and concerns are taken into account.
SANBAG is preparing a cooperative agreement between the five jurisdictions that
will participate in the PSR. It is anticipated that this agreement will be considered
