Description) Special Tax Assessment proceeds Finance: Council Notes: R-eso, d0ob-J-.&5"' Agenda Item No. ---1(P 7/d.'1/0ll e e e CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Resolution approving the 2006/2007 Special Tax Roll for the Assumption ofCSA 38L in newly annexed area generally north of Highland Avenue, East of Golden Avenue, to be known as Special Tax Area 2006-1 BACKGROUND: On January 9, 2006, Resolution No. 2006-10 was adopted, making application to the Local Agency Formation Commission (LAFCO) for annexation of the unincorporated island generally located north of Highland A venue, East of Golden A venue. The application was made pursuant to Assembly Bill 1555, allowing the annexation of completely surrounded areas of 150 acres or less, to be annexed without property owner or registered voter approval. The processing of this annexation known as Annexation No. 359 by LAFCO is now complete, effective June 22, 2006. The approval process by LAFCO included allowing the City to assume a Special Tax in this area, previously approved by the electors of County Service Area 38, Improvement Zone L (CSA 38L) for paramedic services. A copy of LAFCO Resolution No. 2924, approving the annexation, is attached. Paragraph 9 of Section 3 authorizes the transfer of this Special Tax to the City. The established and maximum rate of this tax is $19 annually per residential unit and $38 annually per commercial or non-residential unit (vacant lots are not taxed). The funds collected from this Special Tax may Oli.ly be used for paramedic services within this area, the boundaries of which are the same as the annexation boundaries. The Special Tax is collected on the regular property tax bills. A Special Tax Roll, in the amount of $16,036.00, for 2006/2007 has been prepared, and is shown as Exhibit "A" to the attached resolution approving the roll. The area is to be known as Special Tax Area 2006-1. FINANCIAL IMP ACT: Revenues from CSA 38L in the amount of $16,036.00 are anticipated to cover paramedic services and related costs within the special tax area. On July 10th, 2006, Mayor and Council approved an item authorizing an application to LAFCO to initiate the annexation of six additional unincorporated county islands. That item also authorized the Director of Finance to amend the FY 06/07 Adopted Budget to include the revenue associated with the Del Rosa annexation. CSA 38L -paramedic fee revenue was increased (account number 001-000-4xxx) in the amount of$16,000 as part of that action. WHEREAS, on January 9,2006, the Mayor and Common Council ofthe City adopted Resolution No. 2006-10, making application to the Local Agency Formation Commission for annexation of certain unincorporated territory generally located north of Highland A venue, east of Golden Avenue, known as City of San Bernardino Annexation No. 359, LAFCO 3049, the boundaries of which are shown on Exhibit "A" attached hereto and made a part hereof, more particularly described in said Resolution No. 2006-10; and WHEREAS, on May 17,2006, the Local Agency Formation Commission adopted LAFCO Resolution No. 2924, approving said Annexation No. 359; and WHEREAS, on November 5, 1995, the electors of County Service Area 38, Improvement Zone I, duly authorized a special tax levy for financing paramedic services not to exceed $19 per individual dwelling unit and $38 per commercial unit, per year; and WHEREAS, the area within the boundaries of said Annexation No. 359 is entirely within a portion of said County Service Area 38, Improvement Zone L ("CSA 38L"); and WHEREAS, pursuant to said LAFCO Resolution No. 2924, the Local Agency Formation Commission ordered said annexation area to be detached from CSA 38L and transferring the functions, assets, liabilities, contracts, obligations, responsibilities, and property tax distribution, if any, of said CSA 38L to the City of San Bernardino as successor agency, pursuant to Government Code Section 56886 et seq.; SECTION 1. Fax (909) 387-5871 E-mail: lafco@lafco.sbcounty.gov www.sbclafco.org PROPOSAL NO.: LAFCO 3049 HEARING DATE: MAY 17,2006 AMENDED RESOLUTlON NO. 2924 A RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO MAKING DETERMINATIONS ON LAFCO 3049 AND APPROVING THE CITY OF SAN BERNARDINO ANNEXATION NO. 359 (DEL ROSA ISLAND). The annexation area is an unincorporated island totally surrounded by the City of San Bernardino encompassing approximately 99.22+/- acres, generally north of Highland Avenue, east of Golden Avenue, south of Route 30 and west of Del Rosa Avenue. The site is generally bordered by a combination of Citrus Street and parcel lines on the north, a combination of Park Avenue, Del Rosa Avenue and parcel lines on the east, a combination of Pumalo Street and parcel lines southerly of Orchid Drive on the south, and a combination of parcel lines _ and Golden Avenue on the west. The area is within the City's eastern sphere of influence. On motion of Commissioner McCallon, duly seconded by Commissioner Gonzales, and carried, the Local Agency Formation Commission adopts the following resolution: WHEREAS, an application for the proposed annexation in the County of San Bernardino was filed with the Executive Officer of this Local Agency Formation Commission (hereinafter referred to as "the Conunission") in accordance with the Cortese-Knox-Hertzberg Local Government Reorganization Act of2000 (Government Code Sections 56000 et sea.), and the Executive Officer has examined the application and executed her certificate in accordance with law, determining and certifYing that the filings are sufficient; and, WHEREAS, at the times and in the form and manner provided by law, the Executive Officer has given notice of the public hearing by the Commission on this matter; and, WHEREAS, the Executive Officer has reviewed available information and prepared a report including her recommendations thereon, the filings and report and related information having been presented to and considered by this Commission; and, WHEREAS, the public hearing by this Commission was held upon the date and at the time and place specified in the notice of public hearing and in order or orders continuing the hearing; and, WHEREAS, 'atthe hearing, this Commission heard and receIved all oral and written protests; the Commission considered all plans and proposed changes of organization, objections and evidence which were _made, presented, or filed; it received evidence as to whether the territory is inhabited or uninhabited, improved or: RESOLUTION NO. 2924 e unimproved; and all persons present were given an opportunity to hear and be heard in respect to any matter relating to the application, in evidence presented at the hearing; NOW, THEREFORE, BE IT RESOLVED, that the Commission does hereby determine, find, resolve, and order, as follows: DETERMINATIONS: SECTION 1. The proposal is approved subject to the terms and conditions hereinafter specified: CONDITIONS: Condition No.1. The boundaries are approved as set forth in Exhibits "A" and "A-I" attached. Condition No.2. The following distinctive short-form designation shall be used throughout this proceeding: LAFCO 3049. Condition No.3. All previously authorized charges, fees and/or assessments currently in effect by the City of San Bernardino (annexing agency), with the exception of the City of San Bernardino's 8% utility tax, shall be assumed by the annexing territory in the same manner as provided in the original authorization pursuant to Government Code Section 56886(t). - Condition No.4. County Service Area 38 Improvement Zone L shall be detached from the annexation Wrea as a function of this proposal, with further conditions related to this detachment provided below: !;!1 Upon the effective date of this detachment from County Service Area 38 and its Improvement Zone L, all of County Service Area 38 Improvement Zone L's functions and assets within the detached area (including monies due but uncollected), liabilities, contracts, obligations, responsibilities, and continuing property tax distribution, if any, shall become those of the City of San Bernardino. ili1 The City of San Bernardino shall be the successor agency to all rights, responsibilities, assets and liabilities, and functions of County Service Area 38 Improvement Zone L within the detachment area and the successor agency shall separately maintain such funds in accordance with the provisions of Government Code Section 57462. ~ All previously authorized charges, fees, assessments, and/or taxes of County Service Area 38 Improvement Zone L within the area of this detachment shall be continued by the City of San Bernardino as the successor agency within the boundaries ofLAFCO 3049. Condition No.5. The City of San Bernardino shall indemnify, defend, and hold harmless the Commission from any legal expense, legal action, or judgment arising out of the Commission's approval of this proposal, including any reimbursement of legal fees and costs incurred by the Commission. Condition No.6:'All streetlights currently the responsibility of County Service Area SL-l within the annexation area shall be transferred to the City of San Bernardino upon successful completion of the annexation. ee County Special Districts Department shall prepare the appropriate documentation to transfer the lights, 2 RESOLUTION NO. 2924 e LAFCO staff shall verifY the data, and the City of San Bernardino shall sign the authorization form requesting Southern California Edison to transfer the specific lights to the City of San Bernardino accounts. Condition No.7. Pursuant to Government Code Section 56886.1, public utilities, as defined in Section 216 of the Public Utilities Code; have ninety (90) days following the recording of the Certificate of Completion to make the necessary changes to impacted utility customer accounts. Condition No.8. The date of issuance of the Certificate of Completion shall be the effective date of this annexation. SECTION 2. Pursuant to Government Code Section 56375.3(a)(3), the Commission makes the following findings related to this proposal for annexation: (a) the island comprises a total of 99.22+/- acres, which makes it less than the 150 acre threshold; and the area consists of the entire island of unincorporated territory; (b) the territory is totally surrounded by the City of San Bernardino and is within the City's sphere of influence; (c) the island is substantially developed or developing, based upon the findings that there is the availability of public services; there is the presence of public improvements in the area; and there are physical improvements on many, if not most, of the properties; e (d) the island does not contain any prime agricultural land; and ( e) the island area will benefit from the availability of municipal services from the City of San Bernardino. Therefore, the Commission determines to waive the protest proceedings. This proposal is subject to the provisions of Government Code Section 56375(a)(3) which mandates Commission approval of the proposal ifit complies with the provisions of Government Code Section 56375.3. SECTION 3. FINDINGS. The following findings are noted in conformance with Commission policy: 1. The subject 99.22+/- acre annexation area is legally inhabited as certified by the County Registrar of Voters office, containing 541 voters as of April 18, 2006. 2. The area is within the sphere of influence of the City of San Bernardino. 3. The County Assessor has determined that the value of land and improvements within the annexation area is $44,527,674 ($8,844,590--land; $35,683,084--improvements). 4. Notice of this I)earing has been advertised as required by law through publication in The Sun, a newspaper of general circulation in the area. As required by State law, individual notification was provided to affected and interested agencies, County departments, and those agencies and individuals requesting e 3 e e RESOLUTION NO. 2924 mailed notice. Comments from any affected local agency have been reviewed and considered by the Commission in making its determination. 5. In compliance with the requirements of Government Code Section 56157 and Commission policy, individual notice was mailed to each landowner (totaling 146 notices) and registered voter (totaling 541 notices) within the boundaries of the annexation area and landowners and registered voters surrounding the exterior boundaries of the annexation area (totaling 889 notices). No expression of support or opposition to this annexation and the island annexation provisions has been received. 6. The City of San Bernardino pre-zoned its sphere of influence in May 1991 when it consolidated its General Plan Land Use Map and Zoning Map. These land use determinations were carried forward with- the adoption of the City's Updated General Plan in November 2005. The land use designations to be applied to this area upon annexation are: "RM" residential medium allowing for up to 14 dwelling units per gross acre, "RS" residential suburban allowing for up to 4.5 dwelling units per gross acre, and "CG" commercial general. Pursuant to the provisions of Government Code Section 56375(e), these zoning designations shall remain in effect for two years following annexation unless specific actions are taken by the City Council at a public hearing. 7. The Local Agency Formation Commission has determined that this proposal is statutorily exempt from environmental review. This determination is based on the finding that the Commission's approval of this annexation is ministerial since the ,Commission has made those findings contained in Government Code Section 56375.3 related to annexation of this island. Since the Commission has no discretion in this matter, approval of this proposal is a ministerial action that is exempt from environmental review under the provisions of the California Environmental Quality Act (CEQA), Section 21080(b), the State CEQA Guidelines, Section 15268, and the Commission's adopted CEQA Guidelines. The Commission adopted the Statutory Exemption and directed its Clerk to file a Notice of Exemption within five (5) days with the San Bernardino County Clerk of the Board of Supervisors. 8. The local agencies currently serving the area are: County of San Bernardino, Inland Empire Resource Conservation District, East Valley Water District, San Bernardino Valley Municipal Water District, San Bernardino Valley Water Conservation District, County Service Area SL.I, County Service Area 38 and its Improvement Zone L, County Service Area 70, and the Inland Valley Development Agency. County Service Areas SL-I, 70,38 and Improvement Zone L ofCSA 38 will be detached from the area upon successful completion of the annexation pursuant to the provisions of Government Code Section 25210.90. None of the other agencies will be directly affected by completion of this proposal through an adjustment in their boundaries as they are regional in nature. 9. Upon annexation, the City of San Bernardino will extend its services as required by the existing and anticipated land use. The City has submitted a plan for the provision of services as mandated by Government Code Section 56653, which indicates that revenues are anticipated to be to be sufficient to provide the level of services identified by the City for such items as law enforcement, fire protection, planning, street maintenance, etc. The Plan notes that additional personnel may be required for the provision oflawenforcement services and other services to the annexation area. Water and sewer service to this area is currently provided by the East Valley Water District and will not be changed e 4 e _1. 13. 14. RESOLUTION NO. 2924 following this annexation. The Plan for Service has been reviewed and compared with the standards established by the Commission and the factors contained within Government Code Section 56668. The Commission finds that such Plan conforms to those adopted standards and requirements. The City of San Bernardino has indicated in its application and Plan for Service that its eight percent (8%) utility tax will not be extended to this area upon annexation, and a condition of approval has been included that indicates that the utility tax will not be applied to the island annexation area. The existing special tax authorized for County Service 38 Improvement Zone L (paramedics) will be transferred to the City of San Bernardino upon completion of its detachment as the successor agency. This special tax, authorized by the voters withinCSA 38 Improvement Zone L, will be required to be identified on behalf of and transferred to the City Fire Department for the provision of paramedic services in future fiscal years. The Property Tax Division of the County Auditor/Controller-Recorder's office has indicated that the existing pass-through agreements related to the Inland Valley Development Agency and the City of San Bernardino shall apply to this area upon completion of the annexation. 10. The annexation area can benefit from the availability and extension of municipal services, as evidenced by the Plan for Service. This proposal complies with Commission policies and directives and State law that indicate the preference for all island areas to be included within the boundaries of the City surrounding them to provide for a more efficient and effective service delivery system. 12. This proposal will have minimal effect on the City of San Bernardino's ability to achieve its fair share of the regional housing needs as it is primarily built-out residential uses. The undeveloped residential lands represent less than 5% of the territory. The City and County have negotiated the transfer of ad valorem taxes as required by State law. Copies of the resolutions adopted by the City Council of the City of San Bernardino and the San Bernardino County Board of Supervisors are on file in the LAFCO office outlining the exchange of revenues. The map and legal description, as revised, are in substantial conformance with LAFCO and State standards as determined by the County Surveyor's Office. SECTION 4. The affected territory shall not be taxed for existing bonded indebtedness and/or contractual obligations of the City of San Bernardino. The regular County assessment roll will be utilized by the City. SECTION 5. The reason for this annexation, as provided by the City, is to provide for a more efficient delivery of government services. . .... AECTION 6. The Commission hereby orders the territory described in Exhibits "A" and "A-I" annexed.
