Confidential, Police and Fire Safety employees, Elected Officials, and City of San Bernardino Municipal Water Department. BACKGROUND The Public Employees' Medical and Hospital Care Act (PEMCHA) was enacted in 1962 to provide medical insurance for active and retired employees of the State of California. In 1967, the Act was amended to permit cities and other public agencies to participate. CalPERS offered multiple medical carrier choice, statewide composite rating and simplified administration. Based on these features, the City of San Bernardino contracted with CalPERS for its medical offerings, effective February 1, 1989. The CalPERS Health Insurance Program was in the beginning a positive medical solution for the employees of the City of San Bernardino. Unfortunately, during the last few years, the CaIPERS Health Insurance Program, PEMCHA, has become less competitive for the following reasons: . Less carrier choice-over the last several years, CalPERS has discontinued five (5) carrier offerings: Aetna, CIGNA, Maxicare, Health Net and PacifiCare . Forced benefit plan changes (co-pays and deductibles) . Non-competitive rates (statewide pool) . Higher than trend-rate increases: 25% increase for 2003 plan year, 18% increase for 2004 plan year One of the key factors driving increased costs has been the variation in the cost of care between Northern California and Southern California. CaIPERS staff recently recommended to the CaIPERS Board regional pricing to recognize these market differences between Northern and Southern California. Overall, Southern California has a younger and healther workforce as well as less rural areas. The Board turned down the staff recommendation saying that it would put too big a burden on some Northern California members. Currently, many Southern California agencies are analyzing their option of exiting the CalPERS Health Insurance Program. The City has asked its current dental benefits and property insurance broker, Driver Alliant Insurance Services, to facilitate a comprehensive medical program analysis. The following has transpired: 1. Driver Alliant took the City's employee and retiree specific demographics and used its expertise to leverage the market for similar benefits while reducing 2. Meetings were held with representatives of the various employee bargaining units, management employees and the Water Department, from which a Health Benefits Committee was formed. During these meetings, Driver Alliant presented several recommendations, which included similar plans to those currently offered through CalPERS at more competitive rates. The recommendations included HMO and PPO plan carrier options, including Health Net, PacifiCare, and Blue Shield, which is in addition to continuing to offer Kaiser (Exhibit A, Rate Comparison Charts). 3. All retirees will have similar benefit plan offerings; therefore, no retiree will be left without coverage. The City has agreed to continue to contribute toward the retirees' medical insurance premiums at the same level that CalPERS requires, which will increase each year until it reaches $97 per month in 2008. 4. Driver Alliant has also provided administrative solutions to replace those currently offered by CalPERS and has included enhanced features not offered by CaIPERS. The administration of our benefits will be provided by a third- party administrator, Employee Benefit Specialists (EBS). EBS will be providing benefit enrollment services, eligibility tracking and maintenance, billing services, COBRA, and retiree billing administration. 5. After indepth discussions and analysis, all employee associatIOns recommended opting out of the CalPERS Health Insurance Program, effective January I, 2004. The Committee felt that the recommendations from Driver Alliant are the most viable alternative to the current CalPERS program, and in fact includes enhancements over the current CalPERS offerings. Attached is a memo from Stacey Aldstadt, Deputy General Manager of the Water Department, stating the Board of Water Commissioners' desire to opt out of the CaIPERS Health Insurance Program (Exhibit B). Driver Alliant Insurance Services is charging a commission fee of 2.5% of the insurance premium~the fee is calculated into the premiums paid. The industry standard for this type of commission is typically 4%. This fee includes the following services: . CalPERS Consulting Project . Transition and Communication Support . Implementation . Enrollment Execution . Retiree Billing . COBRA Administration . Benefit Committee Participation . Service Issue Resolution . Annual Renewal Negotiations . Full Benefits Consulting Upon approval of the resolutions, the next step would be to formally notify CalPERS by August 18,2003, of our intention to terminate the medical contract, effective January 1,2004. (Note: we would not be eligible to return to CalPERS for two years). Driver Alliant would then finalize all medical insurance quotes, and the City would meet with the Health Benefits Insurance Committee to make the final selections of our medical insurance carriers. Benefits open enrollment would then be held in October. Administration of the health benefits contract will result in more complex and increased staff duties. To provide appropriate staff for these duties, the Human Resources Department is requesting the reclassification of the current Personnel Analyst position to a new position of Human Resources Supervisor. The new position would retain all of the duties of Personnel Analyst, plus the administration and contract oversight of the health benefits contract. FINANCIAL IMPACT By exiting the CalPERS Health Insurance Program, the City will reduce the out-of-pocket costs to employees for medical insurance. The CalPERS rate increases would have resulted in an average of a 20.63% increase over our current premiums. Changing to the Driver Alliant options will result in 1.4% to 3.1 % average increases depending upon which carriers are ultimately selected. The City has budgeted $110,000 for increased City contributions to medical insurance premiums. Driver Alliant is paid a commission of 2.5% of the insurance premiums for their services. The City would be entering into a one-year-only agreement for the provision of these services. The premium increases in the first year are small, as the City's premiums are now calculated based on our region's costs and our demographics. In future years, premiums will increase along with the market, which in recent years has meant increases of 15%-20% annually. However, by leaving CaIPERS, those increases will be on a lower-base amount. We have been able to secure a rate cap for 2005 rates of 14% for Health Net and 13% for PacifiCare. Also, the City will have the option to solicit bids from other carriers, make plan changes, and take other actions to manage its own costs. Under the current system, the City and its employees are subject to the CalPERS Board. This increase will be offset by approximately $11,000 in salary savings for this fiscal year. The projected additional cost of $5,000 for the upcoming fiscal year will be achieved through health benefit premium savmgs. RECOMMENDATION I. Adopt resolutions. 2. Aldstadt, Deputy General Manager SUBJECT: RESOLUTION OF THE BOARD OF WATER COMMISSIONERS ELECTING TO WITHDRAW FROM THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM HEALTH BENEFITS PLANS (ELECTION TO CEASE TO BE SUBJECT TO THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT) DATE: July 10, 2003 CC: John Perry, Bill Bryden, David Erickson, Jon Turnipseed, Lisa Schultz, Linn Livingston, Brenda Wilder, Tom Valdez, Richard Lemus Background: In accordance with the Memoranda of Understanding between the Board of Water Commissioners and the San Bernardino Water Department Employees' Association and the Board of Water Commissioners and the San Bernardino Association of Water Department Mid-Managers, as well as Resolution No. 603, establishing a compensation and benefits plan for the Water Department Management and Confidential Employees, the Water Department provides health insurance benefits for all full-time employees of the Water Department. In 1988, with City Resolution No. 88-451 (a copy of which is attached), the Water Department elected to be subject to the provisions of the Public Employees' Medical and Hospital Care Act which, in turn, made Water Department employees eligible for health care benefits administered through the Public Employment Retirement System (PERS). In recent years, the costs for health care benefits through PERS have increased dramatically. Last year, the premiums increased an average of twenty-six percent (26%), with even heftier increases for Medicare supplemental plans. This year, PERS has indicated that the premiums will increase almost twenty percent (20%). r<i:emorandum to B. Kersey Re: Resolution Electing to Withdraw from PERS 07/10/03 Last year, the city of San Bernardino contacted Driver Alliant, an insurance broker, to explore whether there would be a cost savings realized by pulling out of PERS for health care benefits and contracting with the various health care providers directly. Driver Alliant shopped the health care plans that the City currently provides and was able to significantly reduce the costs to the City and to employees, while maintaining' essentially the same benefits. Currently, PERS provides four health care options for general unit members (the definition is specific to non-safety personnel, rather than bargainihg units): Blue Shield (a Health Maintenance Organization), California Kaiser, PERS Care (a low-end Preferred Provider Organization) and PERS Choice (a high-end PPO). Before last year, PERS also offered Health Net, Pacificare and Universal Care. Those choices were eliminated effected January 1, 2003. The health care providers contacted by Driver Alliant included Health Net and Pacificare. Driver Alliant asked for quotes from these two providers for an HMO and a PPO. Driver Alliant also asked for quotes from Kaiser (an HMO). When the City (and the Water Department) withdraw from PERS, however, it is possible that Blue Shield might also be able to provide a comparable HMO or PPO for less than it cost under PERS. Based on the quotes, the Water Department would realize a savings of approximately $200,000 a year if the quotes hold (and we expect them to stay or decrease). This would also translate into savings for the employees, with decreases in their costs. The health plans that were quoted are almost identical to those available currently, including co-payments and prescription drug costs. In order to contract with these providers, the City and the Water Department was first required to meet and confer with its employee bargaining units to obtain approval to withdraw from PERS. The City's bargaining units agreed to withdraw. Representatives for the Water Department Employees' Association and Employees' Association and the Board of Water Commissioners and the San Bernardino Association of Water Department Mid-Managers contacted their members and non-members to obtain approval. The Water Department Employees' Association collected signatures from a majority of employees approving the withdrawal. (A copy of the signatories is attached.) The Water Department Mid-Managers 2 M~morandum to B. Kersey Re: Resolution Electing to Withdraw from PERS 07/10/03 Association provided an e-mail to management approving the withdrawal. (A copy of that e-mail is attached.) The final step in moving to the new health care plans is a resolution by the Board of Water Commissioners electing to "cease to be subject to the Public Employees' Medical and Hospital Care Act." If the Board elects to withdraw, then the City will finalize the arrangements with Driver Alliant, which will provide transitional services to the City and the Water Department. Those transitional services include assistance with open enrollment in the fall and administration of claims. Based on the projected cost savings and the approval by the employees, staff recommends that the Board 'of Water Commissioners elect to cease to be subject to the Public Employees' Medical and Hospital Care Act and approve the resolution making the election. Recommendation: Provided that the Board of Water Commissioners concurs, staff recommends that the Board make the following motion: Adopt the resolution electing to cease to be subject to the Public Employees'Medi-cal -and Hospital Care Act. RESOLUTION OF THE CITY OF SAN BERNARDINO MUNICIPAL WATER DEPARTMENT ELECTING TO CEASE TO BE SUBJECT TO THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT. BE IT RESOLVED BY THE BOARD OF WATER COMMISSIONERS FOR THE CITY OF SAN BERNARDINO MUNICIPAL WATER DEPARTMENT AS FOLLOWS: WHEREAS, (I) Government Code Section 22853 provides that a contracting agency which has elected to be subject to the Public Employees' Medical and Hospital Care Act may cease to be so subject by proper application by the contracting agency; and WHEREAS, (2) the City of San Bernardino Municipal Water Department, through the City of San Bernardino, is a contracting agency under the Act for participation by members of the City of San Bernardino Municipal Water Department now, therefore be it RESOLVED, (a) that the City of San Bernardino Municipal Water Department does hereby elect to cease to be subject to the provisions of the Act; and be it further RESOLVED, (b) that coverage of the Act cease on December 31, 2003. Supervises and participates in benefit administration and in the maintenance of the classification system; participates in the development and implementation of procedures to ensure compliance with applicable laws and regulations; reviews contracts of benefit providers and participates in rate evaluations; conducts classification studies or job audits as assigned. 5. Identifies, coordinates and provides training and career development opportunities to all City employees. 6. Advises and assists employees and department management in a variety of personnel matters including the interpretation and application of memoranda of understanding, personnel policies and the processing of employee grievances. 7. Participates in the development and administration of the Department budget; directs the forecast of additional funds needed for staffing, equipment, materials and supplies. 8. Participates in recommending the appointment of Division staff; assigns and supervises the work of professional and technical staff assigned to a small work team; coaches, motivates, monitors, trains, corrects and evaluates performance; recommends employee discipline; approve payroll records. 9. License or Certificate: Possession of a valid Class "C" California Driver's License is required. For out-of-state applicants, a valid driver's license is required.
