STAFF REPORT
Subject:
Resolution awarding a contract to Guzman Construction Company for Street Improvements on
Terrace Road between 6th Street and Maple Street and on 9th Street between Pennsylvania
Avenue and Flores Street and Sidewalk and ADA Access at Highland Avenue and Ramona
Avenue per Plan No. 10620 and 10618.
Background:
As part of the proposed 2003/04 Capital Improvement Program (CIP), staff is recommending
that the Mayor and Common Council allocate a total of $428,000 from the V2 cent sales tax fund
for Street Improvement/Safety Improvement-Citywide in Account No. 129-367-5504--7156. This
account is intended to provide flexible funds for use in solving drainage and safety problems that
are reported to us by City officials and the public.
This project has been identified in the proposed 2003/2004 CIP, Item SS04-13, as one of the
projects to be funded from Account No. 129-367-5504-7156 "Street Improvement/Safety
Improvement-Citywide" .
This project consists of the following:
1. Widening and improving both sides of 9th Street between Pennsylvania A venue and Flores
Street, including construction of curb & gutter, sidewalk, driveway approaches and ADA
access ramps. This Project was requested by the School Principal at a School of the Month
meeting at the Arroyo Valley High School.
2. Construction of a 12" high asphalt dike along the east edge of Terrace Road from 6th Street
to 400' north of Maple Street. This project was requested by residents in lieu of a standard
guard rail.
3. Construction of accessibility improvements along the north side of Highland Avenue at
Ramona Avenue to comply with the Americans with Disabilities Act (ADA), including ADA
curb ramps, sidewalk and related work. This project was requested by the owner of the
Mug Restaurant to complete the sidewalk along Highland Avenue in front of their business.
The plans and specifications for this project are complete, bids have been received and the
contract is ready to be awarded. The estimated project costs are as follows:
Construction Cost (basic bid) $ 185,922.40
Desil!:n, Inspection, and Contract Administration $ 18,077.60
Continl(encies $ 18,000.00
Total $ 222,000.00

BE IT RESOLVED BY THE MAYOR AND CO!\IMON COL'NCIL OF THE
CITY OF SA'" BERNARDINO AS FOLLOWS:
SECTION 1. Guzman Construction Company, 1264 S. Waterman Avenue, Suite # 3,
San Bernardino. CA 92408 is the lowest responsible bidder for Street Improvements on
Terrace Road between 6th Street and Maple Street and on 9th Street between Pennsylvania
A venue and Flores Street and Sidewalk and ADA Access at Highland A venue and Ramona
Avenue per Plan No. 10620 and 10618. A contract is awarded accordingly to said bidder in a
total amount of $185,922.40, with a contingency amount of $18,000.00, but such award shall
be effective only upon being fully executed by both parties. All other bids, therefore, are
hereby rejected. The Mayor is hereby authorized and directed to execute said contract on
behalf of the City; a copy of the contract is on file in the office of the City Clerk and
incorporated herein by reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not
take effect or become operative until fully signed and executed by the parties and no party
shall be obligated hereunder until the time of such full execution. No oral agreements,
amendments, modifications or waivers are intended or authorized and shall not be implied
from any act or course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute
it within sixty (60) days of passage of the resolution.

4. City hereby promises and agrees with the said Contractor to employ, and does hereby employ
the said Contractor to provide the materials and to do the work according to the terms and conditions herein
contained and referred to, for the prices aforesaid, and hereby contracts to pay the same at the time, in the
manner, and upon the conditions above set forth; and the same parties for themselves, their heirs, executors,
administrators, and assigns, do hereby agree to the full performance of the covenants herein contained.
5. It is further expressly agreed by and between the parties hereto that should there be any conflict
between the terms of this instrument and the bid of said Contractor, then this instrument shall control and
nothing herein shall be considered as an acceptance of said terms of said bid conflicting herewith.

At the Mayor and Common Council meeting of August 4, 2003, the City of San Bernardino
adopted Resolution 2003-217 - Resolution awarding a contract to Guzman Construction
Company for street improvements on Terrace Road between 6th Street and Maple Street, and on
9th Street between Pennsylvania Avenue and Flores Street; and sidewalk and ADA access at
Highland Avenue and Ramona Avenue per Plan No. 10620 and 10618.
I am providing you with one certified copy of Resolution 2003-217 and four (4) sets of original
bound contracts. Please obtain signatures where indicated and return one fully executed original
contract to the City Clerk's office as soon as possible.
Please be advised that the resolution and contract will be null and void if not executed
within 60 days, or by October 3, 2003.

Our office has not received the executed contract with Guzman Construction Company for street
improvements on Terrace Road between 6th Street and Maple Street, and on 9th Street between
Pennsylvania Avenue and Flores Street; and sidewalk and ADA access at Highland Avenue and
Ramona Avenue, per Plan No. 10620 and 10618. This contract was approved at the Mayor and
Common Council meeting held on August 4, 2003, and will be null and void if not executed
and returned to the City Clerk's Office by October 3,2003.
Please forward the executed agreement to the City Clerk's Office, to my attention, as soon as
