BACKGROUND: On June 16,2003, Tract No. 14604, located at the southeasterly corner of Magnolia Avenue and Ohio Avenue, was approved. One of the conditions of approval was the formation ofan Assessment District for the maintenance of landscaping along portions of the east side of Magnolia A venue and the north side of Ohio A venue, within the boundaries of the tract. This is being done to assign the costs of maintaining the landscaping to the owners of the properties most benefiting from the landscape area and to prevent blight since property owners usually do not maintain the areas beyond the perimeter block walls of a tract. A letter requesting the formation of the district was received from MAPCO on behalf of the property owner, R. L. Elder Construction Company, along with the processing fee of $4,000. Tract No. 14604 consists of 47 single-family lots. The annual cost of maintenance and incidentals will be spread across these 47 lots. Part of the formation proceedings includes the preparation of an Engineer's Report, which will detail the costs necessary to carry out the ongoing maintenance of landscaping and will be presented with the Resolution of Intention at a future meeting. The annual assessment is estimated to be about $206.00 per lot per year. The annual maintenance costs are unknown at this time but will be included in the Engineer's Report. Since this is a maintenance district, the assessments will run in perpetuity. Approval of this district will be subject to an assessment ballot process, which requires a majority approval by the property owners within the proposed district boundary. Since all of the properties are currently under one ownership, no protests are anticipated. Future homeowners will purchase the homes subject to the assessment district. All potential homebuyers will be given a disclosure notice by the developer, advising them of the existence of an assessment district and the proposed annual cost. FINANCIAL IMPACT: None. Applicant has paid the $4,000 processing fee and all subsequent work carried out in the district will be assessed back to property owners.
