Subject:
Resolution awarding Public Works contract to Centner Construction Company for the ADA
Restroom Rehabilitation at Blair Park and Perris Hill Park, per Plan No. 10353.
Background:
As part of the 2001/02 Capital Improvement Program, the Mayor and Common Council allotted
$73,100.00 in Park Bond Funds for the ADA Restroom Rehabilitation at Blair Park and Perris
Hill Park.
The amount of $73,100 was carried over in the 2002/03 Capital Improvement Program.
Blair Park, located at 1466 W. Marshall Boulevard, has two restroom buildings. The most
southerly building adjacent to the wading pool is part of the basic bid. Perris Hill Park at 1001
E. Highland Avenue has several restroom buildings. The restroom building which is part of this
project is adjacent to the Roosevelt Bowl and is also part of the basic bid. The work involved
with these restrooms shall be the removal of all fixtures and partitions, repair of floors and
walls, construction of partitions, installation of new ADA fixtures, and painting of exterior walls
with anti-graffiti paint.
A second restroom at Blair Park, located on the north side of the park, is an additive alternate to
the basic bid.
The plans and specifications for this Public Works Parks project are complete. The Public
Works Parks project is ready to be awarded. The estimated project costs are as follows:
Construction Cost (basic bid) $ 72,129.00
Design, Inspection, and Contract Administration $ 5,049.00
Contingencies $ 2,822.00
Total $ 80,000.00
This Public Works project was advertised locally in the San Bernardino County Sun Newspaper,
F.W. Dodge, Construction Data Hot Sheet, Daily Construction Service and Bid America,
Construction Bid Source, the City's web sites, and with the San Bernardino Area Chamber of
Commerce. The following four companies responded:

STAFF REPORT
After the bid opening, Service First Contractors Network was the apparent low bidder in the
amount of $63,810.60. Staff reviewed the apparent low bid and found several mathematical errors.
After recalculation, Centner Construction Company was determined to be the lowest responsible
bidder and has met the minimum requirements of the specifications and bid guidelines.
There are insufficient funds available to construct the additive alternate. Therefore, staff is
recommending that a contract for the basic bid only be awarded to Centner Construction Company.
Lemuel Randolph, Director of the Department of Parks and Recreation, concurs with staff's
recommendation.
Financial Impact:
The current balance in Account No. 243-363-5504-7270 "Blair/Roosevelt Restrooms" is
approximately $68,000. The Department of Parks and Recreation is proposing to carryover the
current balance and allocate an additional $12,000 from Park Construction Funds in the FY
2003/04 Budget to provide a total amount of $80,000, which will be adequate to fund the
project.
Recommendation:
Adopt resolution.

BE IT RESOLVED BY THE l\1A YOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Centner Construction Company, 12521 Ruth Lane, Yucaipa, CA 92399

is the lowest responsible bidder for the ADA Restroom Rehabilitation at Blair Park and Perris
9
10 Hill Park project, per Plan No. 10353. A contract is awarded accordingly to said bidder in a
11

total amount of $72,129.00, with a contingency amount of $2,822.00, but such award shall be
effective only upon being fully executed by both parties. All other bids, therefore, are hereby
rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of
14
the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein
15
16 by reference as fully as though set forth at length.

SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or

22 course of conduct of any party.
23 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
24 within sixty (60) days of passage of the resolution.
