Account Description: Listed above Finance: Council Notes: Agenda Item No. 13 7//0100 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Authorization to Proceed and Resolution making application - Reorganization consisting of the annexation of 6 areas of unincorporated territories generally lying north of Pacific Street, east of Valencia Avenue, south of Piedmont Drive and west of Victoria Avenue, to be known as City of San Bernardino Annexation No. 361. BACKGROUND: On January 21, 2000, Assembly Bill 1555 became effective, allowing for the annexation of unincorporated territory of 75 acres or less, without the need to obtain property owner or registered voter approval. Subsequently, an amendment increased the qualifying area to 150 acres. On February 21,2006, the Mayor and Common Council authorized the filing of an application for annexation with the Local Agency Formation Commission (LAFCO) for the Arrowhead Springs area. At that time, LAFCO staff indicated that a condition of approval for this annexation would be for the City to initiate and complete annexation of portions of various islands pursuant to Assembly Bill 1555. The provisions of AB 1555 terminate on January 1, 2007 and any proposals initiated pursuant to it must be completed by this date in order to qualify as a no vote no protest annexation. LAFCO staff have further indicated that the initiation, processing and completion time will be about 6 months. The attached map shows the location of the various islands, or portions of islands under this proposal. The areas range in size from a few acres to just over 60 acres. LAFCO initially recommended 12 island areas for consideration. However, after reviewing the cost for services, primarily from Police and Code Enforcement, versus the anticipated revenues, staff is recommending 6 of the 12 islands for consideration under this proposal. These 6 islands would have the least service impact to the City. Language in the attached resolution states the City's commitment to phase in the remaining islands under Assembly Bill 2223. If approved, AB 2223 will extend the provisions of AB 1555 until 2014. The attached Exhibit 1 shows the 12 areas originally proposed for annexation. Exhibit 2 shows the 6 areas being proposed by staff. The combined 6 areas total approximately 94 acres. One of the islands in this general area, which is known as the Del Rosa area and is not part of this proposal, was submitted to LAFCO previously, after Mayor and Council approval, and was recently approved by LAFCO and is now part of the City. This island is generally north of Highland Avenue, between Del Rosa Avenue and Golden Avenue. The Police Department has indicated that these 6 islands could be absorbed without a more significant impact. Staff is recommending the addition of two new Code Enforcement Officer II positions this fiscal year. Although there are no multifamily complexes in the proposed 6 areas, the Del Rosa area that was previously annexed has thirty-two complexes and over 850 units. Staff is recommending that a Administrative Clerk be added to the Fire Department to assist with the additional inspections, as well as any other fire prevention related inspections/enforcement in the annexation area. This position will process all mailings of administrative citations and all other related documentation to the program, be responsible for the filing of all documentation related to the apartment inspections and re-inspections for the inspection staff, assist in the handling of the increased walk-in traffic, and the additional phone calls. This position will allow more time for the Fire Prevention Technicians to conduct the required inspections. There will also be some infrastructure needs in these areas, but they will be minimal. Revenue from the Del Rosa annexation will be realized in FY 2006-07. Because the annexation of the proposed 6 islands is not likely to be final until the end of this year, revenue from this source will not be realized until FY 2007-08. Revenue sources from these annexed islands typically includes property tax, Vehicle License Fees (VLF), paramedic fees (CSA 38L), and multifamily inspection fee revenue (if applicable). The City's Utility User's Tax cannot be imposed on these areas after annexation, since Proposition 218 requires voter approval of any new taxes and the proceedings for annexation will be conducted without voter approval. Property tax revenue has historically been calculated by a pre-negotiated tax transfer percentage between the City and the County (17% average of the total tax). AB 1602 -VLF allocations to Cities, is pending in the State Legislature which proposes to change the allocation of VLF funds to cities by allocating an additional $50 per capita for the population in those newly annexed areas at the time of annexation. There is no known opposition to this bill. If passed, this bill would mean an additional $145,000 to $165,000 per year in additional VLF revenue (Del Rosa area and the proposed 6 new areas). CSA 38L is a $19 per unit tax for paramedic service. Residents in these areas would not pay the City $250 paramedic fee for services provided. Other than conducting tax transfer negotiations with the County, which will occur at a later date and be conducted by the City and the County, all other proceedings will be conducted by LAFCO including mailed notices and a public hearing. A public outreach and informational meeting was held on June 7, 2006, and the property owners and residents affected under this proposal were given information as to the process and given an opportunity to ask questions. About 50 residents or property owners attended the meeting. The most common concern and opposition to this proposal was the fact that LAFCO had conditioned approval of the Arrowhead Springs annexation upon the City completing the island annexations and that the area was being annexed without the consideration of property owner and/or registered voter consent. Although this proposal will not completely eliminate all of the various islands that now exist, it will reduce the areas and better align some of the boundaries, without a significant impact on servIces. Attached is a Resolution making application and various filing documents as required by LAFCO, including a Plan for Services and financial impact. The total LAFCO filing fees of $12,756 ($2,000 per island or portion of an island plus $756 for legal fee deposit) are due at the time of filing. Staff is requesting a waiver of all of, or portion of, the filing fee, since this reorganization is being conditioned by LAFCO as a result of the Arrowhead Springs area annexation. If the waiver is approved by the Commission, the City will receive a refund of the portion being waived. Additional fees will be due at the end of processing, which are not LAFCO fees but fees to other agencies such as the State Board of Equalization. The amount of those fees are unknown at this time and will be determined at a later date. FINANCIAL IMPACT: EXPENDITURES: LAFCO filing fees and the required deposit total $12,756. Salaries and equipment total $112.400, REVENUE: In FY 2006/07, revenue from the Del Rosa Area Annexation (No.359) will be approximately $112.400. This consists of property tax revenue of 76,000 - Account #001-000-4001; CSA 38L paramedic fee revenue of $16,000 - Account # 001-000-4xxx), Vehicle License Fee revenue of $2,500 _ Account # 001-000-4603, and Multifamily Inspection Fee revenue of $17,900 - Account #001-000-4155, In FY 2007/08, revenue from the proposed 6-island annexation will be approximately $71,600. This consists of property tax revenue of $60,300, CSA 38L - paramedic fee revenue of $5,600, and Vehicle License Fee revenue ofS5,700. There are no multifamily complexes in these areas. Additionally, as mentioned above, if AB 1602 -VLF allocations to Cities passes later this year, an additional S145,000 - 165,000 in VLF revenue will be realized from the Del Rosa area and the 6 island areas. RESOLUTION OF THE CITY OF SAN BERNARDINO MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO FOR A REORGANIZATION CONSISTING OF ANNEXATION TO THE CITY OF SAN BERNARDINO OF 6 AREAS OF UNINCORPORATED TERRITORIES, GENERALLY LYING NORTH OF PACIFIC STREET, EAST OF V ALENCIA AVENUE, SOUTH OF PIEDMONT DRIVE AND WEST OF VICTORIA AVENUE, TO BE KNOWN AS ANNEXATION NO. 361. WHEREAS, the City of San Bernardino desires to initiate proceedings pursuant to Cortese-Knox-Hertzberg Local Government Reorganization Act of2000 (Section 56000 et. SECTION 3. No special conditions shall be required or imposed on the property owners or residents of the areas proposed to be annexed under this proposal other than what is normal and customary of annexations into the City of San Bernardino, except that these areas will not be assessed the City's Utility User's Tax. SECTION 4. The City of San Bernardino will assume all revenues now collected by the County of San Bernardino pursuant to County Service Area (CSA) 38 L for paramedic services. SECTION 5. DESCRIPTION OF SERVICES . Fire Protection Services: All proposed Areas are currently served by the City of San Bernardino Fire Department pursuant to an agreement with the County of San Bernardino. The City will continue to provide fire services for these areas after annexation. The nearest fire stations to the proposed annexation Areas are as follows: Area I: No. 226 Area 2: No. 226 Area 3: No. 226 Area 4: No. 226 Area 5: No. 226 Area 6: No. 227 1920 Del Rosa Ave, 92404 282 W. 40th Street, 92407 In addition to fire and paramedic services, citywide services include disaster preparedness and emergency operations. CSA 38L fees are currently collected in county pockets and will continue to be collected after annexation. All estimates for services are based on 2000 census data. Multi-family complexes of four units or more located within the City are charged a mandatory fee for fire prevention inspections. Inspection rates vary by the size of the complex. There are no multi-family complexes that meet the criteria within the six proposed annexation areas. . Police Protection Services: The Areas are presently served by the San Bernardino County Sheriff. After annexation, the City of San Bernardino Police Department will provide police services. The Department currently has approximately 312 sworn officers. This includes 206 patrol/traffic officers, 46 detectives, 44 sergeants, 11 lieutenants, 3 captains, 1 Assistant Chief and I Chief. The department will also offer a "Crime Free"(Rental Housing) and all other crime prevention services to all proposed annexation areas. No additional fees are charged for routine services. Based on data analysis, the San Bernardino Police Department will absorb any additional costs of services for the proposed areas, no additional officers are needed at this time. All estimates for services are based on 2000 census data. . Water & Sewer Services: Areas 1-6 are currently receiving water delivery and sewage disposal from the East Valley Water District, which will continue after annexation. . Public Services/Refuse: Pursuant to City of San Bernardino policy, residents of a newly annexed areas may continue to use their current refuse provider for a period of up to five years after the date of annexation, or may have refuse services provided by the City anytime I before that period. The current single family residential rate is $19.86 per month for once a week pick- up and includes the provision of three containers (normal, recycle-able and green waste). Commercial rates vary depending on the type and frequency of pick up. Additional services, such as old appliance pick-up or special pick up for large and hard to handle items are available for an additional fee. The City also has a comprehensive recycling program including the collection of used oil and tires. . Public Services/Streets: The street division provides monthly street sweeping, street/sidewalk repair and street tree trimming. No additional fees are charged for these services. After completing the windshield survey of potential annexation areas it is believed the following costs will be incurred by the City: 1. Additional 172,480 square feet of right-of-way to be sprayed for weeds- $12,000 2. Sign upgrades to City standards- $1,200 3. Many of the street name and stop signs that are now controlled by the county will need to be replaced to bring them up to City standard - $1,600 4. Edison maintains the streetlights in county controlled areas, and they all appear to be within the City street lighting policy. If additional lighting is needed Edison will install with little or no cost to the City. The City will assume the maintenance costs for these lights after annexation and upon a completion of an agreement with County. Those costs are unknown at this time. ' Total Cost - $14,800 It is expected that these services will be funded through anticipated revenue. Any difference will be offset by the general fund. . Development Services: The Development Services Department provides planning, building and engineering services related to land development, including new development and additions. The permit fees vary, depending on the type of development. The Public Works Division of the Development Services department also provides services such as street rehabilitation and storm drain installation and repair. These types of projects are normally part of the City's five year Capital Improvement Program and funding is normally provided by either the general fund or various transportation funds such as gas tax funds. No additional fees are charged for these services. . Code Compliance/Enforcement: Currently the City of San Bernardino has a staff of 32 personnel that administer code compliance services. These services include housing improvement, neighborhood revitalization and weed abatement. Abatement costs are normally billed or assessed to the owners of property on which abatement activity occurs. The recent Del Rosa annexation did not include an increase in code enforcement officers. The City is proposing that two (2) new officers be added to cover the newly annexed areas. The cost for two officers including uniforms, radios and office equipment is approximately $115,000 for the first year and $110,00 each additional year after. 2 A portion of these costs will come from anticipated revenues from this annexation, with the remainder to be paid from the general fund. . Animal Control: The City of San Bernardino will provide Animal control services. No additional fees will be charged for these services. Any animal currently licensed by the County of San Bernardino will be honored until the license expiration, at that time all animals must be licensed with the City. Additional services, such as spay/neutering, adoption and vaccination, are available on an individual basis for an additional fee. EFFECTIVE DATE OF SERVICES . All City services will be available to property owners and/or residences on the effective date of annexation. IMPOSITION OF INFRASTRUCTURE IMPROVEMENTS or OTHER CONDITIONS . The area is primarily developed; therefore, no immediate need for infrastructure improvements have been noted.
