Subiect:
Resolution of the Mayor and Common Council of the City of San Bernardino Amending
Resolution 96-188 relating to Section 5.03.370 of the San Bernardino Municipal Code
concerning Business Registration and Permit Fees.
Backl!round:
The Patrons of the Roosevelt Bowl (Patrons) is incorporated as a 501(c)(3) non-profit
organization for the purpose of providing financial, physical, and program support for arts,
culture, entertainment, and community activity at the Roosevelt Bowl Outdoor Amphitheater
(Bowl) in San Bernardino's Perris Hill Park (Park). The Patrons of the Roosevelt Bowl Articles
of Incorporation specify that the residents of the city of San Bernardino and this particular City-
owned facility will be the sole benefactors of the Patrons activities.
The Patrons are seeking to establish a Market Night event at Perris Hill Park in an effort to raise
funds for needed improvements to the Bowl. Market Night is proposed as a year-round event
held on Tuesday evenings from 6-9:30 p.m. The event will provide a mechanism to restore the
Bowl and bring arts, culture, educational programming, entertainment, and community activity
to the Bowl. An agreement between the City and the Patrons of the Bowl to provide City
support services for this event is on today's agenda.
Section 5.04.370 of the Municipal Code provides that the fee for a booth selling food or
merchandise shall be set by resolution. Resolution 96-188 sets that fee at $10 per day. Under
the current Resolution, vendors participating in the Perris Hill Market Night event would be
responsible to pay $10 per day in Business Registration Fees. Because 100% of the profits from
this event will benefit a City owned facility (the Bowl), the Patrons have requested that the
Registration Fee to the vendors be decreased to $24 per year. The $24 fee amount is generally
consistent with what other cities charge vendors for Market Night.
In order to accomplish the fee change, Resolution 96-188 must be amended to add the following
language (changes noted in italics):

OF SAN BERNARDINO AMENDING RESOLUTION 96-188 RELATING TO
SECTION 5.03.370 OF THE SAN BERNARDINO MUNICIPAL CODE CONCERNING
BUSINESS REGISTRATION AND PERMIT FEES.
WHEREAS, under the current resolution vendors in conjunction with a carnival or
similar activity are charged $10 per day for a Business Registration Fee; and
WHEREAS, Market Night at Perris Hill Park, organized by the Patrons of the
Roosevelt Bowl, has established a vendor space rental fee to help renovate the Roosevelt Bowl,
a City-owned facility; and
WHEREAS, reducing the existing Business Registration Fee for those vendors
participating in this event will encourage more vendors to participate, resulting in additional
revenue being available to renovate the Roosevelt Bowl, a City-owned facility.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO THAT RESOLUTION 96-188 IS
HEREBY AMENDED TO ADD THE FOLLOWING LANGUAGE:
