STAFF REPORT
Subject:
Resolution awarding contract to Pro Tech Engineering, Corp., for Street Lighting on Base
Line Street from Victoria Avenue to a point 1000' westerly per Plan No. 10397.
Background:
This project was approved in the FY 2002/03 Capital Improvement Program and consists of
the installation of street lighting and electrical service. The selection of this site was by citizen
request and successfully competed statewide with other projects. On July 26, 2000, this project
was deemed eligible for further consideration and placed on the Statewide Prioritized List of
Recommended Hazard Elimination Safety (HES) projects to be programmed in the 2001/2002
Federal Fiscal Year. The project has been designed and will be inspected by in-house staff.
This should allow the City to complete the design and inspection of the project for the total
sum of only $4,627.00.
The HES Program provides funds for safety improvements on public roads, public surface
transportation facilities, publicly owned bicycle or pedestrian pathways or trails, and for traffic
calming measures. These funds are intended to be used to eliminate or reduce the number and
severity of traffic accidents at locations selected for improvement. This project was nominated
for funding prior to the formation of the Grants Ad Hoc Committee.
Plan and specifications for this project are complete and it is ready to be awarded. The
estimated project costs are as follows:
Construction Cost $19,873.00
Contingencies $5,500.00
Design, Inspection, and Contract Administration $4,627.00
Total $30,000.00
This project was advertised locally in the San Bemardino County Sun Newspaper, Construction
Trend Newspaper. the City's web site, and with the San Bernardino Area Chamber of
Commerce; the following companies responded:

Financial Impact:
Funding for this project in the amount of $30,000 has been included in the FY 2002/2003
budget in the Traffic Systems Construction Fund. Of the $30,000, $24,750 will be funded by
the Hazard Elimination Safety Program (HES). The remainder of the cost (the required local
match) will be funded from the Traffic System Fee Fund. All costs incurred will be charged to
Account No. 250-370-5504-7335 (Base Line St. HES Street Lights Installation from Victoria
Avenue to 1000' westerly).

RESOLUTION NO.
SECTION 1. Pro Tech Engineering Corp., is the lowest responsible bidder for Street

9 Lighting on Base Line Street from Victoria Avenue to a point 1000' westerly, per Plan No.
10 10397. A contract is awarded accordingly to said bidder in a total amount of $19,873.00, with
11 a contingency amount of $5,500.00, but such award shall be effective only upon being fully
12
executed hy both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby
13

15 on file in the office of the City Clerk and incorporated herein by reference as fully as though
16
authorized and directed to execute said contract on behalf of the City; a copy of the contract is
set forth at length.
17 SECTION 2. This contract and any amendment or modifications thereto shall not take
18
effect or become operative until fully signed and executed by the parties and no party shall be
19
20
obligated hereunder until the time of such full execution. No oral agreements, amendments,
21 modifications or waivers are intended or authorized and shall not be implied from any act or
22 course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
24
within sixty (60) days of passage of the resolution.

agreement was approved at the Mayor and Common Council meeting held on January 21, 2003,
and will be null and void ifnot executed and returned to the City Clerk's Office by March 24,
2003.
