Subject:
Resolution of the City of San Bernardino approving Amendment No.2 to Agreement for Professional
Services with David Evans & Associates, Inc. for additional design services associated with the
widening of Del Rosa Drive and 3"' Street at the San Bernardino International Airport.
Backllround:
On February 19, 2002, a Professional Services Agreement in the amount of $45,946.00 was approved
with David Evans & Associates, Inc. for design of the widening of Del Rosa Drive and 3"' Street at the
San Bernardino International Airport.
On June 17, 2002, Amendment No. I to Professional Services Agreement in the amount of $12,300.00
was approved with David Evans & Associates, Inc. for additional design services for landscaping of
Del Rosa Drive and 3"' Street at the San Bernardino International Airport
During the design process preliminary potholing was done to locate the existing 6-inch fuel line in 3"'
Street which had been installed in the 1950's for the Air Force. Based on the potholing information it
was estimated that the line would be approximately 18 inches below the surface. The consultant design
engineer included a reinforced concrete cap over the line to protect it from traffic loads.
During construction the contractor, while doing the required and more comprehensive field potholing,
discovered that the depth and alignment of the jet fuel line was highly variable and, in fact, was only II
inches below the surface of the fmished pavement in some areas.
Staff consulted David Evans and Associates, Inc. to determine the best way to protect the line from
traffic loads. David Evans and Associates, Inc. was asked to attend two field meetings and to design a
concrete cap capable of transferring all traffic loads to the soil below the fuel line, therefore, resulting
in no load being placed on the fuel line. David Evans and Associates, Inc. prepared the design;
however, it was determined the most cost effective method of protecting the line was to lower it to a
depth of 36 inches below the surface.
The above work was not covered in the "Scope of Services' in the Agreement as Amended and we feel
the proposed fee of $1,000.00 for these additional design services is reasonable. Therefore, staff
recommends approval of this Amendment No. 2 to the Agreement with David Evans & Associates, Inc.
Alex Estrada, Property Manager for IVDA, has indicated that the IVDA will be recommending that
their Board concur with the approval of this Amendment No. 2 to the Agreement with David Evans &
Associates, Inc.
Financial Impact:
The cost for additional services associated with Amendment No.2 to the Agreement is $1,000.00.
Adequate funding for these design services is available in Account No. 242-362-5504-7339 (Widening
of Del Rosa Drive and 3"' Street at SBIA) and all costs incurred will be charged to that account.
The original budget for this contract consisted of approximately $436,730.00 which remained from the
Federal Economic Development Agency (FedEDA) grant. An additional amount of $192,769.00,
including $90,000.00 in contingencies, was reserved by lVDA to assure reimbursement of all costs
incurred by the City for this Contract. The amount of the contingencies is sufficient to cover the cost of
all change orders and this Amendment No.2 to Agreement with David Evans & Associates, Inc.
Recommendation:

SECTION I. The attached Proposal dated December 30. 2001. and marked

Engineer authorized by Resolution No. 2001-52. is hereby approved. Such apprO\al shall be
13 etlective only upon Amendment NO.2 being fully executed by both panies. The :vlayor is
14 hereby authorized and directed to execute said Amendment '\'0 2 on behalf of the City. A
15 copy of Amendment NO.2 is attached as Exhibit "A" and incorporated herein by reference a,

fully as though set forth at length.

SECTION 2. This Amendment shall not take effect until the Amendment is fully
19 signed and executed by the panies. and no pany shall be obligated hereunder until the time of
20 such full execution. :\0 oral Contracts. amendments. modifications or \\aivers are intended or
21 authorized and shall not be implied from any act or course of conduct of any pany.

SECTION 3. This resolution is rescinded if the panies to the Amendment fail to

execute it within sixty (60) days of the passage of the resolution.

AMENDMENT NO.2 TO AGREEMENT FOR PROFESSIONAL SERVICES
This AMENDMENT NO.2 is made and entered into this of
2003, by and between the CITY OF SAN BERNARDINO, California, a municipal
corporation, hereinafter referred to as the "CITY" and David Evans & Associates, Inc.,
hereinafter referred to as "ENGINEER".
WITNESSETH
WHEREAS, the San Bernardino City Council, on February 19, 2002,
adopted Resolution No. 2002-52 approving an Agreement for Professional Services with
Engineer for preparation of plans, specifications, and estimates for the design of the
widening of Del Rosa Drive and 3" Street at San Bernardino International Airport
(hereinafter "Agreement"); and
WHEREAS, the San Bernardino City Council, on June 17, 2002, adopted
Resolution No. 2002-170 approving Amendment No. 1 to Agreement for Professional
Services with Engineer for additional design services related to the design of the widening

"Aareement")' and

WHEREAS, City requested the Engineer to perform additional design
services described, in general. as attending construction meetings and providing alternate
designs for the protection of the fuel line in 3" Street; and
WHEREAS. Engineer has requested an amendment to the Agreement to
cover the cost of the additional design services as described in a letter proposal from
Engineer dated December 30, 2002, marked as Exhibit "B" attached hereto and made a part
hereof; and
WHEREAS, paragraph 5.B. of the Agreement allows adjustment to the total
cost of services when the Engineer and City agree in writing that there has been, or will be,
a significant change in the scope, complexity or character of the services to be performed;
and
WHEREAS, City agrees that the requested revisions are not within the scope
of services covered in the Agreement; and
NOW, THEREFORE, it is mutually agreed, as follows:
1. SCOPE OF SERVICES
Engineer shall perform those additional services identified in Exhibit "B".
2. COMPENSATION
Upon satisfactory completion of the additional services contained herein City
shall pay to Engineer an additional fixed fee of $1,000.00.
EXHIBIT "A"
AMENDMENT NO.2 TO AGREEMENT FOR PROFESSIONAL SERVICES WITH
ENGINEER DAVID EVANS & ASSOCIATES, INC.
3. NO ADDITIONAL CHANGES
Except as otherwise stated in this Amendment No.2, all terms of the original
Agreement, as approved by City on February 19, 2002, shall remain in full
force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment No.2 to
Agreement to be executed on the date written above by their duly authorized officers on
their behalf.

we are superseding it with a change order request 10 cover oUr time expended on the protection of
the fuel line only.
As you know Dayid Eyans and Associates. Inc. (DEA). allended construction meetings and
provided alternate designs for the protection of the fuel line in 3"' Street. Although the final
decision was to relocate the line. We were requested to attend these meetings and look at
alternatives.
DEA would hereby like to request a change order in the amount of $1,000 to assist in covering
the addilionaltime that was expended above. Should you have any questions or require
clarification on any matter, please feel free to call.
