DescriDtionl Finance: Council Notes: /9 ..;::::- CITY OF SAN BERNaDINO - REQUEST Fa COUNCIL ACTION STAFF REPORT During December, 1989, and January, 1990, urgency ordinances and resolutions were adopted by the Mayor and Common Council relating to the infrastructure fee for the Verdemont area of the community. This fee is to be used to construct right-of-way improvements in the area. One Mello-Roos Community Facilities District has been formed to pay this fee, and others may be formed in the future. In all of the draft copies of the Engineer's Report for the infrastructure fee, a schedule was set forth that escalated the fee by 15% for each of the first three years and by 10% for the next two years. In the final ordinance, as adopted, the schedule was replaced with a statement that the fee would be adjusted by duly adopted resolutions by the Mayor and Common Council as deemed necessary to cover the cost of the proposed improvements, carrying costs, inflation, etc. In all meetings concerning the formation of MellonRoos districts, one of which has formed, staff presented the public with the information on the excalation schedule anticipated for the area. The escalation factors are the same as have been used for the treatment plant expansion and were deemed to be adequate and fair as well as providing encouragement to join districts or make advance payments of the fee. The first yearly date is approaching and staff is recommending the attached resolution be adopted, again setting forth the schedule for escalation of the fee. Language is still within the ordinance to revise, either up or down, the escalation based on actual experience and the desires of the Mayor and Common Council as it relates to additional items being added to the work. However, the schedule will preclude a yearly amending resolution being needed and allow the development com- munity to have a clear picture of the intent of the City as it relates to this fee. It will also assist in the provision of information for additional financing districts that may be pro- posed. Staff recommends that escalation schedule be approved. URGENCY CLAUSE: The intent of the infrastructure fee and all information released to date has been that the fee will escalate by 15% as of January 1, 1991, for the first 3 years, and 10% for the next 2 years. WHEREAS, the City of San Bernardino, California (the "City") has on January 3, 1990, previously adopted an Urgency Ordinance (MC-695) which established and authorized the levy of an infrastructure fee (the "Infrastructure Fee") for the purposes of funding the costs of certain Right-of-Way Improvements and Public Improvements, all as more fully described in the January Urgency Ordinance; and WHEREAS, in connection with its adoption of the January Urgency Ordinance, the City on January 3, 1990, also adopted a Resolution (Resolution 90-2) setting the amount of the Infra- structure fee; and WHEREAS, on June 25, 1990, Section 1 of Resolution 90-2 was amended by Resolution 9-253, revising the amount of Infra- structure fee; and WHEREAS, the City deems it necessary to adopt this Resolution in order to provide for a revision to the amount of the Infrastructure Fee set in the June revision to Resolution 90- 2 which revision is attributable to the escalation of the infrastructure fee for Right-of-Way Improvements as defined in the ordinance. SECTION 1: Infrastructure Fee. The Infrastructure Fee 4 as established pursuant to the Urgency.
