STAFF REPORT
Bids for this project were opened at 2:00 p.m. on
November 27, 1990.
A total of 15 bids were received and ranged from a high
of $425,984.80 to a low of $254,565.54. The low bid was 35%
below the Engineer's Estimate of $396,876.00.
Listed below is the anticipated project cost based on
the actual low bid for the construction contract:

Funds for this construction project are in the Indian

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO BOB BRITTON, INC. FOR CONSTRUCTION OF STREET AND
3 CHANNEL IMPROVEMENTS ON LYNWOOD DRIVE AND SAND CREEK.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Bob Britton, Inc.
is the lowest responsible
bidder for:
Construction of Street and Channel Improvements on
Lynwood Drive and Sand Creek, in accordance with Plan No. 8021;
and a contract
is awarded to said bidder accordingly for the
total amount of $254,565.54, but such award shall be effective
only upon the contract being fully executed by the parties; all
other bids therefore are hereby rejected; and the Mayor is hereby
authorized and directed to execute said contract on behalf of the
City; a copy of the contract is attached hereto, marked Exhibit

"A" and incorporated herein by reference as fully as though set
forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution.
No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
