STAFF REPORT
Bids for the improvements under this contract were
opened at 2:00 p.m., Tuesday, 11-13-90. Two projects, handicap
ramps at various locations and street improvements on Tenth
Street (north side), from "D" Street to Arrowhead Avenue, are
included in this contract to reduce administration costs.
A total of 11 bids were received, ranging from
$31,644.40 to $61,810.70. The low bid of $31,644.40 is 30.6%
under the Engineer's Estimate of $45,600.
Below is an estimate of the total estimate project cost,
based upon the actual low price bid:

An amount of $50,000 has been allocated, under Account
No. 121-544-57961, to finance the costs incurred for construc-
tion of the handicap ramps, and an amount of $10,000 has been
allocated under Account No. 121-544-52544-00000-0052, to finance
the street improvements on Tenth Street, for a total available
amount of $60,000.

We recommend that a contract be awarded for the low bid
URGENCY CLAUSE
A handicap ramp will be constructed on the north side of 21st
Street, at Kenwood Avenue, for use by patients of St.
Bernardine I s Hospital. The hospital staff has requested that
this ramp be constructed as soon as possible, due to several
near accidents.

STREET, FROM "D" STREET TO ARROWHEAD AVENUE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE .
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
B-1 Enterprise Corporation is the lowest

and a contract is awarded to said bidder accordingly for the
11 total amount of $31,644.40 for Bid Schedule I & II, but such
12 award shall be effective only upon the contract being fully
13 executed by the parties 1 all other bids therefore are hereby
14 rejected1 and the Mayor is hereby authorized and directed to
15 execute said contract on behalf of the CitY1 a copy of the
16 contract is attached hereto, marked Exhibit "A" and incorporated
17 herein by reference as fully as though set forth at length.
18 SECTION 2. This contract and any amendment or modifica-
19 tions thereto shall not take effect or become operative until
20 fully signed and executed by the parties and no party shall be
21 obligated hereunder, until the time of such full execution. No
22 oral agreements, amendments, modifications or waivers are
23 intended or authorized and shall not be implied from any act or
24 course of conduct of any party.
25 SECTION 3. This resolution is rescinded if the parties
26 to the contract fail to execute it within sixty (60) days of the
27 passage of this resolution.
