STAFF REPORT
Bids for the replacement of the decomposed granite
walkways, in Phase I-A of Seccombe Lake Park, were opened at
2:00 p.m., Tuesday, 10-30-90.
A total of 9 bids were received, ranging from
$66,860.30 to $268,000.00. The low bid of $66,860.00 is 14.5%
under the Engineer's Estimate of $78,200.00.
Listed below is the estimated total project cost,
based upon the actual low bid price.

Budget, under Account No. 243-363-57507, to finance the costs
incurred for this project. The sources of these funds are:

The grant from the State requires 30% in matching
funds, 5% of which must be non-City funds. This is the reason
for the allocation of $10,000 from CDBG Funds.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MOONLIGHTING CONSTRUCTION, INC. FOR REPLACEMENT OF
DECOMPOSED GRANITE WALKWAYS IN SECCOMBE LAKE PARK WITH PORTLAND
CEMENT CONCRETE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Moonlighting Construction, Inc. is the lowest
responsible bidder for:
Replacement of Decomposed Granite
Walkways in Seccombe Lake Park with Portland Cement Concrete
Walkways, in accordance with Plan No. 8234; for the total amount
of $66,860.30, a contract is awarded to said bidder accordingly,
but such award shall be effective only upon the contract being
fully executed by the parties; all other bids therefore are
hereby rejected; and the Mayor is hereby authorized and directed
to execute said contract on behalf of the City; a copy of the
contract is attached hereto, marked Exhibit "An and incorporated
herein by reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
