STAFF REPORT
The Water Department drilled a new water production well on a
parcel of land northwest of the intersection of Garner Avenue and
Olive Street.
Southern California Edison requires an easement for their electric
facilities to serve the well, to include underground wiring and a
pad mount transformer.
It is recommended that the grant of easement be approved.

NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION ONE:
That the City of San Bernardino, a Municipal
Corporation, does hereby grant an easement to Southern California
Edison Company to provide additional electrical service to the
Water Department's Olive Street and Garner Avenue Well Site,
located at 1048 Garner Avenue.
SECTION TWO:
That the said Grant of Easement referred to

13 herein, a copy of which is attached hereto, marked Exhibit "1", and

is hereby referred to and made a part hereof as fully as though
set forth at length herein, is hereby approved.
SECTION THREE: That the Mayor and City Clerk of the City of
San Bernardino are hereby authorized and directed to execute said
Grant of Easement on behalf of the City of San Bernardino.

CITY OF SAN BERNARDINO, a municipal corporation, (hereinafter referred 10 as -Grantor-), hereby
9rant to SOUTHERN CAliFORNIA EDISON COMPANY, a corporation, illIoucceseors and uaigno (herainafter
referred to as -Grantee-), an easement and right of way to construct. use, maintain, operate, alter, add
to, repair, replace. reconstruct. inspect and remove at any time and from time to time underground
electrical supply systems and communication systems (hereinafter referred to as .systems.), consisting
of wires. underground conduits. cables, vaults, manholes, handholes, and including above-ground
enclosures, markers and concrete pads and other appurtenant fixtures and equipment necessary or useful
for distributing electrical energy and for transmitting intelligence by electrical means, in, on, over,
under, across and along that certain real property in the County of San Bernardino, State of California,
described as follows:
The Weste~y 10 feet of the Northe~y 14 feat of tha Easte~y 36.50 feet of Lot 2.
ALSO, the Southa~y 6 feet of the Northerly 15 feet of the Eastarly 26,50 feet of Lot 2.
Said Lot 2 lying within and being a part of Tract No. 2141, as per map recorded in Book 31, page 33
of Maps, in the Office of the Recorder of said County.
The Grantor agrees for itself, its successors and assigns, not to .rect, place or maintain, nor to
permit the .rection, placement or maintenance of any building, planter boxe., earth fill or other
structures except walls and fences on the above described real property. The Grantee, and its
contractors, agent. and employees, shall have the right to trim or cut tr.. roots a. may endanger or
interfere with said systems and shall have free access to said systems and every part thereof, at all
times, for the purpose of exercising the rights herein granted; provided, however, that in making any
excavation on said property of the Grantor, the Grantee shall make the same in such manner as will cause
the ieast injury to the surface of the ground around such excavation, and shall replace the earth so
removed by it and restore the surface of the ground to as near the same condition as it was prior to such
excavation as is practicable.
