Although the reasons for such continuances may be justified, each time an item is placed on the agenda City costs are incurred in Staff time, reproductions costs, notices, distribution, etc. It seems appropriate that these costs should be borne by the party requesting the continuances. The attached Ordinance and Resolution would set that fee at $75.00. o 0' 75-0264 .' o 1 2 3 4 o o ORDINANCE NO. AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION 2.58.200 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO CONTINUANCES OF ITEMS ON THE AGENDA OF THE MAYOR AND COMMON COUNCIL. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWS: 6 SECTION 1. Section 2.58.200 is hereby added to the San 7 Bernardino Municipal Code to read as follows: o 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o I I I I I I I "2.58.200 Continuances; fee Any person, firm, corporation or other entity having an appeal, or other item on the agenda of the Mayor and Common council may request a continuance of such item by submitting a written request therefor to the City Clerk prior to the item being heard. Such request must be accompanied by a processing fee established by resolution of the Mayor and Common Council. The granting of a continuance shall be subject to the complete discretion of the Mayor and Common Council taking all of the facts and circumstances of the matter into consideration. Should the request for a continuance be denied the fee paid shall be returned upon application by the payor. Any subsequent request for a continuance shall require an additional fee."
