DescriPtion) Vacation filin2 fees Finance: CCil Notes: 10-15-90 Ammrla Item No. ~9 CITY OF SAN BERNAINO - REQUEST FcQ COUNCIL ACTION o c o 75-0264 STAFF REPORT A request was received by this office to vacate the North/South alley West of Waterman Avenue, between Alexander Street and 27th Street, from the owner of the commercial building to the East of the alley, Spellacy & Associates (a real estate office). Two residential properties are located to the West of the alley, one home faces Alexander Avenue, the other, 27th Street. Neither property uses the alley for access. The alley is being used as a trash dump and an area for other illicit purposes. On 04-02-90, authorization was given to proceed with the proposed vacation, and Plan No. 8092 was approved. All of the interested City Departments and utility Companies were notified of the proposal on 05-11-90, with a reply due by 06-11-90. The responses are attached for your information. Reservation of an easement for sanitary sewer and appurtenant facilities was requested, along with requests for reservations of easements from General Telephone, Southern California Edison and Southern California Gas for public utility purposes, which will all have to be reserved, as set forth in the attached Resolution of Intention. The trash bins will be moved to the front of the building for trash pick-up and access. RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF THAT NORTH/SOUTH ALLEY BETWEEN ALEXANDER AVENUE AND 27TH STREET, WEST OF WATERMAN AVENUE, AND RESERVING EASEMENTS FOR SANITARY SEWER AND APPURTENANT FACILITIES AND EASEMENTS FOR PUBLIC UTILITIES THEREIN. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECT! ON 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of that North/South alley between Alexander Avenue and 27th Street, West of Waterman Avenue, described as follows: That certain North/South alley, as per plat recorded in Book 46 of Maps, Page 68, in the office of the County Recorder of the County of San Bernardino, described as follows: Beginning at the Northwest corner of Lot 2, Tract No. 3534, records of said County; thence South along the West line of said Lot 2, a distance of 252.42; thence West along the North line of 27th Street, 45.00 feet in width, a distance of 30.00 feet; thence North and parallel with said West line of said Lot 2, a distance of 252.42 feet; thence East along the South line of Alexander Avenue (Pioneer Way), 60.00 feet in width, a distance of 30.00 feet to the Point of Beginning. SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in vacating the above described portion of said streets, elect to proceed under and in accordance with the provisions of the "Public Streets, Highways and Services Vacation Law", being Division 9, Part 3, of the Streets and Highways Code of the State of California. SECTION 3. For further particulars as to the proposed vacation of the hereinbefore described portion of said streets, reference is made to that map marked "Plan No. 8092" approved April 2. 1990. on file in the office of the City Clerk of said City. SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing easements for public utility purposes belonging either to the City of San Bernardino or to any public utility. There is hereby specifically reserved, for the City of San Bernardino, an easement in. over. under and across the entire area of the proposed vacation for sanitary sewer and all appurtenant facilities. and to use, maintain. repair. replace or renew such facilities. There are also specifically reserved. easements for General Telephone, Southern California Edison and Southern California Gas to construct. place, operate. inspect, maintain, repair, replace and remove such aerial and underground telephone, telegraph and communication structures, electrical transmission structures and gas lines respectively, as the companies may from time to time require, consisting of poles, anchors, wires, cables. conduits. manholes. markers, pipelines and necessary fixtures and appurtenances. SECTION 5. That the City Engineer of the City of San Bernardino is hereby directed to cause Notices of Street Vacation to be posted as required by the Public Streets. Highways and Services Vacation Law. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published once a week for two successive weeks in The Sun, a newspaper published and circulated in the City of San Bernardino, prior to the date of the above public hearing. / / / / 2 ..
