The Charter presently prevents the Fire Chief from
assigning Battalion Chiefs that are on a 56-hour
work week to a 40-hour work week, unless authorized
to do so by resolution of the Common Council.
Because of the lack of administrative staff in the
Fire Department, the Fire Chief wants to have the
ability to assign 56-hour work week Battalion Chiefs
to a 40-hour work week schedule to assist in research,
analysis, and development of revenue enhancing or
efficiency oriented programs on a temporary basis.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO GRANTING THE FIRE
CHIEF AUTHORITY TO CHANGE THE WORKING HOURS OF BATTALION CHIEFS
IN THE FIRE DEPARTMENT.
WHEREAS, the City Charter Section 186 defines "shift" as a
4 24-hour duty for the Fire Department, except for certain
5 positions and for those safety positions as may be granted a 40-
6 hour work week by resolution of the Common Council;
7 WHEREAS, Battalion Chiefs currently work 24-hour shifts;
8 and,

WHEREAS, the Fire Chief deems it necessary to have
10 Battalion Chiefs oversee certain special projects on a 40-hour

week basis;
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
Section 1.
That the Fire Chief is hereby granted the
authority to assign Battalion Chiefs to a forty-hour work week
16 for periods not to exceed one (1) year, as necessary for
17 specific projects.
18 I HEREBY CERTIFY that the foregoing resolution was duly
19 adopted by the Mayor and Common Council of the City of San
