STAFF REPORT
Bids for this project were opened on September 4, 1990,
at 2:00 p.m. A total of 4 bids were received and ranged between
$298,895.00 and $397,893.00.
The low bid of $298,895.00 was 8.25% under the
Engineer's Estimate of $323,575.00.
Under Public Contracts Code Section 10285.1, the bidder
is required to advise the City of any convictions for violations
of these provisions within the past three years. The low bidder
has so indicated a conviction in 1987 for violations in 1979.
In checking with Caltrans, the Contractor has not been disbarred
from a bidders list, and there is no reason to withhold the
award to this bidder on this project.
Written concurrence with the award to the low bidder has
been received from Local Assistance at Caltrans.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO STEINY AND COMPANY, INC. FOR TRAFFIC SIGNAL
MODIFICATION AND INTERCONNECT ON NINTH STREET, "H" TO SIERRA WAY,
AND "E" STREET, SIXTH TO TENTH STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Steiny and Company, Inc. is the lowest
responsible bidder for:
Traffic Signal Modification and
Interconnect on Ninth Street, "H" to Sierra Way, and "E" Street,
Sixth to Tenth Street, in accordance with Plan No. 7618: for the
total amount of $298,895.00, a contract is awarded to said bidder
accordingly. but such award shall be effective only upon the
contract being fully executed by the parties: all other bids
therefore are hereby rejected: and the Mayor is hereby authorized
and directed to execute said contract on behalf of the City: a
copy of the contract is attached hereto, marked Exhibit "A" and
incorporated herein by reference as fully as though set forth at
17 length.
18 SECTION 2. This contract and any amendment or modifica-
19 tions thereto shall not take effect or become operative until
20 fully signed and executed by the parties and no party shall be
21 obligated hereunder until the time of such full execution. No
22 oral agreements, amendments, modifications or waivers are
23 intended or authorized and shall not be implied from any act or
24 course of conduct of any party.
25 SECTION 3. This resolution is rescinded if the parties
26 to the contract fail to execute it within sixty (60) days of the
o 27 passage of this resolution.
