This fee has since been revised as part of an update of fees collected by the various departments within the City. Presently the fee is $100. In July of 1985, the Mayor and Common Council adopted a resolution providing for on-site plan check and inspection. This resolution made it possible for the Public Works inspection staff to provide inspection outside the public right of way for on-site "hardscape" improvements. Ori- ginally set up as a calculated fee based on footages of various types of improvement, it was amended in August of 1988 to become a percentage of the construction costs. Plan check was set at 0.30% and permit inspection set at 0.25% of the estimated cost of the improvements. These numbers were selected to approximate the then current charges and in no way reflected the actual cost of providing the service. In fact, Resolution No. 88-284 sets forth that shortages shall be made up out of the City General Fund. At present, fees for the plan check and inspection for off-site improvements are set at 2% and 1.5% respectively. These fees also do not cover actual costs but were established at the "average" of surrounding cities as of 1987, and they represent about 35% - 40% recovery of actual costs incurred. In January of 1988, a policy paper was issued for landscaping. All City Departments have since been required to comply with this policy paper. The paper sets forth that plans are to be submitted to the Department of Public Works and that copies will be distributed to the Parks and Recreation and Planning Departments for review and comment, in order to assure that requested information or comments are addressed prior to approval of the final plan. Also, to assure that all conditions are met prior to release of Certificate of Occupancy and release of bonds. Addi tionally, Public Works staff, as well as Parks and Recreation staff, must provide inspection services for these landscape improvements. The present $100 review fee does not begin to cover the actual expense of this service. The attached resolutions and ordinance are structured to delete the landscape plan review fee in Resolution No. 83-201 and amendments, place the plan check fee in Section 15.04.175 of the Municipal code and provide for inspection fees to be collected by authority of 15.04.177 of the Municipal Code and to amend Resolution No. 88-284 by increasing the plan check fee from 0.30% to 2% and the inspection/permit fee from 0.25% to 1. 0%. However, a polling of our inspectors indicates that a good portion of time is spent on on- site inspections and that the level of service is approximately 70% of what is provided for public works improvements in the public right of way. At their meeting of 9-20-90, the Legislative Review Com- mittee recommended that these amendments be approved. Section 54992 of the Government Code requires that a public meeting be held to receive oral or written presentations before levying any new fee or service charge. This public meeting must be held during a regularly scheduled Council meeting. We recommend that a public meeting be scheduled for the Council meeting of 11-5-90. 10-03-90 o o o o o 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 83-201 ENTITLED, IN PART, "RESOLUTION. 3 .MODIFYING FEES FOR PLANNING SERVICES, ENGINEERING SERVICES, AND USES OF BUILDINGS, SPORTS FACILITIES AND EQUIPMENT. ."1 TO 4 DELETE THE LANDSCAPE PLAN REVIEW FEE. 5 WITNESSETH: 6 WHEREAS, Landscape Plan Review fees are established in 7 Resolution 83-201, Section 2, I. Planning Fees, line "P"1 and 8 WHEREAS, Landscape Plans are now subject to complete plan 9 check procedures coordinated by the Public Works Department in 10 concert with the Departments of Planning/Building Services and 11 Parks, Recreation and Community Servicesl and 12 WHEREAS, the existing Plan Review Fee is insufficient to 13 cover costs for full plan check servicesl and 14 WHEREAS, the City Municipal Code provides for on-site 15 plan check and inspection services in section 15.04.1751 and 16 WHEREAS, it is proposed that Section 15.04.175 be amended 17 to specifically provide for landscape plan check servicesl and 18 WHEREAS, Landscape plan check and inspection services are 19 on site inspection and checking services. 20 NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 21 SECTION 1. RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 88-284 ENTITLED, IN PART, "RESOLUTION. .ESTABLISHING ON-SITE IMPROVEMENT PLAN REVIEW FEES AND PERMIT FEES," TO INCREASE PLAN CHECK FEE. WITNESSETH: WHEREAS, a hearing has been held by the Mayor and Common Council pursuant to the provisions of Government Code Section 54990, et seq., to consider the levy of new and additional fees and service charges for various services provided by the Department of Public Works/City Engineer, which hearing was held following public notice published in a newspaper of general circulation in the City of San Bernardino; and WHEREAS, none of the proposed increases exceed the actual cost of providing such services and, for those services which are not completely paid for by the proposed fees, the additional expense to the City of providing the services shall be borne by the general fund of the City of San Bernardino; and WHEREAS, the proposed fees and charges are reasonable and necessary to enable the City of San Bernardino to more nearly meet the actual costs of providing such services. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: SECTION 1. Section 3 of Resolution No. 88-284 is amended to read as follows: "Pursuant to Section 15.04.175 of the San Bernardino Municipal Code, on-site improvement plan review fees shall be 2.0% of the estimated cost of the on-site improvements shown on the plans." 10/3/90 o o o FEE o o 1 SECTION 2. Section 4 of Resolution No. 88-284 is amended 2 to read as follows: 3 "Pursuant to Section 15.04.177 of the San Bernardino 4 Municipal Code, on-site improvement permit fees shall be 1.0% of 5 the estimated cost of the on-site improvements being inspected." 6 SECTION 3. In no case shall the plan check or permit fee 7 be less than $25.00 each for administrative costs. 8 SECTION 4. ORDINANCE OF SUBSECTION 15.04.175 ESTABLISHING ON-SITE INCLUSION OF LANDSCAPE THE CITY OF SAN BERNARDINO AMENDING OF THE SAN BERNARDINO MUNICIPAL CODE IMPROVEMENT PLAN REVIEW FEES BY THE IMPROVEMENTS. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Subsection 15.04.175 of the San Bernardino Municipal Code is hereby amended as follows: UBC Section 7007(d) is added to read: "Section 7007(d). On-Site Improvement Plan Review Fees. When an on-site improvement plan is required to be submitted, a plan review fee shall be paid at the time of submitting plans and 12 specifications for review. Said review fee shall be in an amount 13 established by resolution of the Mayor and Common Council. 14 Items to be reviewed are improvements including, but not 15 limited to: paving, curbs, sidewalks, private sewer mains, and 16 drainage facilities. The review of landscaping, and irrigation 17 are included in the on-site improvement plan review." 18 SECTION 2.
