These zones are for a maximum of 3 minutes for passenger loading (white), maximum of 20 minutes for short term parkers (green), and for loading (yellow). The installation and periodic repainting of these zones is done by City Forces, which results in costs being incurred for this work. Since these zones are installed and maintained at the request of the owner/tenant, and are for their benefit, it seems appropriate that they should bear the cost. The proposed resolution establishes an initial installa- tion fee of $125 per space (20 feet) for passenger loading and time limit zones, and a fee of $50 for each additional adjoining space. A fee of $175.00 will be established for each loading zone, up to 40 feet. These fees are set to cover our estimated cost for receiving and reviewing a request for a new zone, applying the curb painting and markings, and for obliterating those zones no longer needed. An annual fee of $50 will be established for each passenger and time limit zone, with a fee of $25 for each adjoining space. For loading zones, the annual fee will be $75. While the funds generated by these fees will not be a considerable amount, they will insure that those who receive a special use parking space will pay the cost incurred in installing and maintaining the necessary painting. Also, the fee schedule will result in zones being removed due to failure to pay the annual maintenance fee. A public meeting was set for the Council meeting of 10- 15-90, as required by Section 54992 of the Government Code. RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING AN INSTALLATION FEE AND ANNUAL MAINTENANCE FEE FOR PASSENGER LOADING ZONES, TIME LIMIT ZONES AND LOADING ZONES. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL AS FOLLOWS: WITNESSETH: WHEREAS, there are numerous passenger loading zones, time limi t loading zones, and loading zones on public streets and parking lots throughout the City; and WHEREAS, designation of these zones is done by painting the curbs white, green or yellow, as stipulated by the California Vehicle Code; and WHEREAS, painting the curbs to designate these zones entails an initial expense to the City, as well as periodic repainting as required; and WHEREAS, many of these zones are no longer needed, due to changes in ownership, type of business, etc; and WHEREAS, these zones are installed at the request of adjoining owners and/or businesses for their benefit; and WHEREAS, the City desires to establish an initial installation fee and annual maintenance. fee for these special parking zones, in order to recover costs incurred for initial painting and periodic repainting of the curbs; THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL 24 OF THE CITY OF SAN BERNARDINO, AS FOLLOWS: 25 SECTION 1. The initial installation fee shall be paid before a new zone is painted by City forces. The annual maintenance fee for 1990/91 shall be paid within 15 calendar days after receiving notice that the amount is due and payable, and by July 1 for each succeeding fiscal year. Failure to pay the annual maintenance fee by July 15 shall result in the painting being obliterated by City forces to eliminate the special parking use. SECTION 3.
