STAFF REPORT
The Water Department is upgrading the Leroy Well at our Waterman
Plant for extraction of water. We are installing a larger
horsepower motor and pump on the well to increase production and
to lift the water from lower levels as the water table drops.
The upgrade of the pumping equipment requires the installation of
a new electrical panel and the installation of a pad mount
transformer by Southern California Edison. The transformer and
associated underground electric lines require granting an easement
to Southern California Edison for their facilities.
It is recommended that the grant of easement be approved.

RESOLUTION NO.
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO GRANTING AN EASEMENT TO SOUTHERN CALIFORNIA EDISON
COMPANY FOR ADDITIONAL ELECTRIC SERVICE AT THE WATER DEPARTMENT'S
LEROY WELL SITE.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION ONE:
That the City of San Bernardino, a Municipal
Corporation, does hereby grant an easement to Southern California
Edison Company to provide additional electrical service to the
10 Water Department's Leroy Well Site, located at 3101 Leroy Street.

SECTION TWO:
That the said Grant of Easement referred to
12 herein, a copy of which is attached hereto, marked Exhibit "1", and
13 is hereby referred to and made a part hereof as fully as though
14 set forth at length herein, is hereby approved.
15 SECTION THREE: That the Mayor and City Clerk of the City of
16 San Bernardino are hereby authorized and directed to execute said
17 Grant of Easement on behalf of the City of San Bernardino.
18 I HEREBY CERTIFY that the foregoing resolution was duly
19 adopted by the Mayor and Common Council of the City of San
20 Bernardino at a meeting thereof, held

CITY OF SAN BERNARDINO. a Municipal corporation, (hereinafter r.ferred to as -Granlor"), hereby
grant to SOUTHERN CALIFORNIA EDISON COMPANY. a oorporation, its successors and ..signs (hereinafter
referred to as -GranteeR). an easement and right of way 10 construct, use, maintain, operate, alter, add
to, repair, replace, reconstruct, inspect and remove at any lime and from time 10 time underground
electrical supply systems and communtcation systems (hereinafter referred to as .systems.), consisting
of wires, underground conduits, cables, vaults, manholes, handholes, and including above-ground
enclosures, markers and concrete pads and other appurtenant fixtures and equipment necessary or useful
for distributing electrical energy and for transmitting intelligence by electrical means, in, on, over, f
under, across and along that certain real property in the County of San Bernardino, State of California, ~
described as follows:
The Westerly 10 feet of LOT 5. BLOCK 3. TRACT NO. 1809, GARDEN ESTATES UNIT '2, as
per map recorded in Book 26, page 22 of Maps, in the Office oftha Recorder of said County.

The Grantor agrees for itself, its successors and assigns, not to erect, place or maintain, nor to ~

permit the erection, placement or maintenance of any building, planter boxes, earth fill or other g
structures except walls and fences on the above described real property. The Grantee, and its ..
contractors, agents and employees, shall have the right to trim or cut tree roots as may endanger or I

interfere with said systems and shall have free access to said systems and every part thereof, at aU i
times, for the purpose of exercising the rights herein granted; provided, however, that in making any
excavation on said property of the Grantor, the Grantee shall make the same in such manner as will cause
the least injury to the surface of the ground around such excavation, and shall replace the earth so
removed by it and restore the surface of the grouncl to as near the same condition as it was prior to such
excavation as is practica~e.
