FUNDING REQUIREMENTS: Amount: $44,304.48 per yea r Source: Federa 1 Funds Finance: ./ ./,~- CoO Notes: 75-0262 Agenda Item No .:J. 9 CITY OF SAN BERNA:)DINO - REQUEST FcQ COUNCIL ACTION o STAFF REPORT On June 16, 1980, the Mayor and Common Council adopted Resolution No. 80-253, which authorized the execution of a Lease Agreement with the Sedlak Family Trust for the building located at 646 North Sierra Way (SBETA Office). The building contains approximately 7225 square feet and is accompanied by a black topped parking area that will accommodate approximately 75 vehicles. The lease was for a period of 27 months, commencing July 1, 19BO, and ending September 30, 1982. The agreed upon monthly rental fee was $3,251.25 for the first year, $3,413.81 the second year, and $3,584.50 the third year. One year extensions to the Lease Agreement, at a monthly rental fee of $3,584.50, were authorized through the adoption of Resolutions 83-274, 84-336, and 85-276. On August 4, 1986, the Mayor and Common Council adopted Resolution No. 86-311, which authorized both a one year extension of the Lease Agree- ment and a 3% increase in the rent to $3,692.04 per month (approximately 51 cents per square foot). Additional extensions to the Lease Agreement at a monthly rental fee of $3,692.04 were authorized in 1987, 1988 and 1989. . o The Lease Extension is for a period of two (2) years, beginning October 1, 1990 and ending September 30, 1992, and the monthly rental fee of $3,692.04 will remain the same. The building will be used to administer the Job Training Partnership Act programs, and approximately $2,500,000 in JTPA funds has been made available to the San Bernardino Employment and Training Agency for Fiscal Year 1991. Justifications for the Lease Extension include: 1. The building is easily accessible to job seeking clients, with ample parking space and a nearby public transportation system. 2. The building has a large conference room that is utilized by the 24 member Private Industry Council for their meetings. 3. RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN EXTENSION OF TERM OF LEASE WITH THE SEDLAK FAMILY TRUST EXTENDING THE TERM OF THE LEASE ENTERED PURSUANT TO RESOLUTION NO. 89-402 FOR THAT CERTAIN OFFICE BUILDING COMMONLY KNOWN AS 646 NORTH SIERRA WAY. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said City an Extension of Term of Lease with the Sedlak Family Trust to lease for an additional two (2) years that certain office building commonly known as 646 North Sierra Way. Said lease is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. Holcomb, Mayor o 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o o o o EXTENSION OF TERM OF LEASE This agreement, made and entered this day of , 1990, by and between the Sedlak Family Trust, hereinafter called the Lessor, and the City of San Bernardino, hereinafter called the Lessee, attests: WHEREAS, by written lease dated the 24th of June 1980, the Lessor did let and lease to the Lessee certain premises fully described in said lease (and briefly described as that certain office building commonly known as 646 North Sierra Way containing approximately 7225 square feet, along with 75 parking spaces) for a term beginning July 1, 1980, and ending September 20, 1982, and extended for one year periods with agreements dated August 8, 1982, August 19, 1983, August 30, 1984, July 16, 1985, August 5, 1986, September 21, 1987, September 19, 1988 and October 2, 1989, and under the terms and considerations therein set forth. Within 90 days from the date of execution of the Extension of Term of Lease, the Lessor shall: 1. Replace corroded plumbing fixtures in the areas designated as the Men's and Women's Restrooms. 2. Install counter-type bathroom sink and vanity base cabinet in Men's and Women's Restrooms. 3. Install four foot fluorescent light fixture above mirror in Women's Restroom. 4. All work shall be completed to the satisfaction of the Lessee. Breach of any of the terms of this amendment shall constitute a material breach of the agreement. Upon such breach Lessee shall have the same rights as set forth at paragraph 16 of that lease dated October 4, 1989 respecting a partial destruction of the premises, save that any calculation of damages shall commence on the 9lst day following date of execution of this extension.
