Synopsis of Previous Council ection:
7/14/69
Resolution 9913 was unanimously adopted by the Mayor and Common Council
authorizing execution of a Joint Powers Agreement creating the East Valley
Planning Agency between the City of San Bernardino, County of San Bernardino
and the Cities of Colton, Fontana, Redlands, and Rialto.
1/4/71
Resolution 10562 was unanimously adopted by the Mayor and COmmon Council
amending the Joint Exercise of Powers Agreement creating the East Valley
Planning Agency and permitting the City of Lorna Linda to become a member
thereof.

Second Amendment to the Joint Powers (JPA) for the East
Valley Planning Agency
By letter dated October 1, 1990, Sharon Hightower, Director of
the Planning Department for the County of San Bernardino,
submitted to the City Clerk a draft resolution and the Second
Amendment to the Joint Powers (JPA) for the East Valley Planning
Agency, for adoption by our City Council. The amendment removes
the County's Fourth District Supervisor from the JPA. As a
result of redistricting, the Fourth District boundaries are no
longer a part of the East Valley Region. The principal function
of the Planning Agency is to act as the Airport Land Use
Commission.
The City Attorney's Office has prepared a resolution authorizing
the execution of the second amendment and it is recommended that
the resolution be adopted.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF A SECOND AMENDMENT TO AGREEMENT AMONG THE CITIES OF

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor is hereby authorized and directed to
8 execute on behalf of said City an Amendment to Agreement, among
9 the cities of Colton, Fontana, Red1ands, Ria1to, San Bernardino,
10 Loma Linda and the County of San Bernardino for the purpose of
11 making certain amendments to the Joint Exercise of Powers
12 Agreement creating the East Valley Planning Agency, relating to
13 changing the membership provisions.

RE: Second Amendment to the East Valley Planning Agency JPA
Dear Ms. Krasney:
Please find attached a draft resolution and the Second Amendment
to the Joint Powers Agreement (JPA) for the East Valley Planning
Agency, for adoption by your city council. The Amendment removes
the County's Fourth District Supervisor from the JPA. As a
resul t of redistricting, the Fourth District boundaries are no
longer a part of the East Valley Region. The principal function
of the Planning Agency is to act as the Airport Land Use
Commission.
The draft resolution is provided for your convenience. So long
as your council approves the amendment and authorizes someone to
sign it, any customary form of taking those actions is acceptable.
Please return the executed amendment and a copy of your city
Council action to the Clerk of the Board of supervisors, as the
amendment will not become effective until all of the member
cities and the Board of Supervisors have adopted and signed it.
In order to expedite action on this amendment, we propose to have
the parties sign separate counterpart copies rather than
circulating the same document for signature by all. Please leave
the date on the first page blank, but enter your date of execution
next to your city's signatures.
The complete set of counterpart copies will be dated, copied and
copies sent to you after they are all signed. Should you have
any questions regarding this letter, or the attachments, please

THiS AMENDMENT TO AGREEMENT, dated for convenience this
day of , 1990, among the Cities of Colton, Fontana,
Redlands, Rialto, San Bernardino, Lema Linda and the County of
San Bernardino for the purpose of making certain amendments to
the Joint Exercise of Powers Agreement creating the East Valley
Planning Agency, dated the 29th day of December, 1969
("Agreement"), as amended December 14, 1970, by changing the
membership provisions.
The Agreement is hereby amended as follows:
1. Subsection B of Section 3 of the Agreement is amended to
read as follows:
B. The agency shall be administered by a governing
board of nine members, each serving in his or her
individual capacity as a member of the governing
board. The members of the governing board shall be
appointed in the following manner: The city
Council of each city party to this Agreement shall
appoint one council member as a governing board
member and an alternate council member to serve in
the absence of the regular council member. The
Board of Supervisors of the County of San
Bernardino shall appoint three supervisors, each of
whose districts is included in the East Valley
area, as governing board members, and two alternate
Supervisors, each of whom may serve in the absence
of one of the regular supervisor members.
Governing board members shall serve at the pleasure
of their respective appointing authorities. The
governing board shall be called "Governing Board of
the East Valley planning Agency". All voting power

2. This agreement shall take effect and be in force on the
date when the last party has executed an identical counterpart
copy and filed it with the Clerk of the Board of the San
Bernard~no County Board of supervisors.

its signature.

Resolution No.
WHEREAS, the County of San Bernardino and the cities of the
East Valley, (Colton, Fontana, Redlands, Rialto, San Bernardino,
Lema Linda) did form, under a Joint Powers Aqreement dated December
29, 1969, the East Valley Planninq Aqency, as an advisory aqency
to promote coordinated and comprehensive planninq: and
WHEREAS, the qeneral purpose of this aqency is to provide a
vehicle by which the -individual cOlDlllunities of the East Valley
areas of the County of San Bernardino may proceed with special
planninq studies needed within their respective cOlDlllunities while
assurinq that the planninq studies are coordiriated [within the
framework of a comprehensive area-wide plan]: and
WHEREAS, the East Valley Planninq Aqency was conceived to
include all incorporated cities in the East Valley, to be
qoverned by a Governinq Board composed of one council member
appointed by each incorporated city and the County Supervisors
whose districts lie within the East Valley: and
WHEREAS, as a result of redistrictinq, the Fourth
supervisorial District no lonqer encompasses land areas within
the East Valley reqion: and
WHEREAS, the aqreement should be amended to delete the
Fourth Supervisorial District: and
WHEREAS, the duly elected supervisor of the Fourth District
has requested to be deleted from the membership of the East
Valley Planninq Aqency: and
WHEREAS, deletinq the Fourth Supervisorial District leaves
positions for three County Supervisors on the qoverninq board: and
WHEREAS, desiqnation of the remaininq two County Supervisors
as alternatives will advance the purposes of county representation
and the achievement of a quorum,
NOW, THEREFORE, BE IT RESOLVED, that the city Council of the
City of adopts the Second Amendment to
the Joint Powers Aqreement creatinq the East Valley Planning
Aqency, to reduce County membership on the qoverninq body to
three Supervisors and to provide for desiqnation of the remaining
two County Supervisors as alternates, and further Authorize the
