Bids for the installation of traffic signals and highway
lighting were opened at 2:00 p.m., Tuesday, 8-7-90.
A total of 6 bids were received, ranging from
$164,485.00 to $209,370.03. The low bid of $164,485.00 is 12.4%
under the Engineer's Estimate of $187,789.00.
The special provisions stipulate that at least 10% of
the contract price must be done by Disadvantaged Business Enter-
prises (DBE). Information on participation by DBE's was sub-
mitted by the two low bidders, as provided in the special
provisions. Two of the four DBE's listed by the Matich Corp.,
the apparent low bidder, have not been certified by Caltrans.
Therefore, this bid has been deemed non-responsive and not in
compliance with the provisions of the contract.
Participation by DBE's in the second low bid, by Steiny
and Company, Inc. was found to meet the required level of 10%.
Cal trans has approved awarding a contract to the second low
bidder. The second low bid of $172,325.00 is 8.2% under the
Engineer's Estimate of $187,789.00.
Listed below is an estimate of the total project cost,
based upon the actual second low bid:

TOTAL ESTIMATED PROJECT COST $ 255,000
The necessary supplemental funding of Federal-Aid Urban
Funds was approved by SANBAG, which increased the available
funds, under Account No. 242-362-57372, to about $263,000.
In accordance with Public Contract Code Section 10285.1,
all bidders are required to state if they have been convicted in
the past three years of any offenses referred to in that section
of the code. The second bidder has indicated a conviction with-
in the past three years. However, Caltrans has reviewed the

bid, checked the disbarment of bidders list, and determined that
there is no reason to withhold the award to this bidder.
We reconnnend that a contract be awarded to the second
low bidder.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO REJECTING THE
LOW BID FROM THE MATICH CORPORATION AND AWARDING A CONTRACT TO
STEINY AND COMPANY, INC. FOR THE INSTALLATION OF TRAFFIC SIGNALS
AT DEL ROSA DRIVE AND NINTH STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The low bid submitted by the Matich
Corporation, in the amount of $164,485.00, is hereby rejected for
being non-responsive to the target level of participation in the
contract price by Disadvantaged Business Enterprises.
SECTION 2.
Steiny & Company, Inc. is the lowest
responsible bidder for: Installation of traffic signals at Del
Rosa Drive and Ninth Street, in accordance with Plan No. 73481
for the total amount of $172,325.00, a contract is awarded to
said bidder accordingly, but such award shall be effective only
upon the contract being fully executed by the parties I all other
bids therefore are hereby rejectedl and the Mayor is hereby
authorized and directed to execute said contract on behalf of the
CitYl a copy of the contract is attached hereto, marked Exhibit
"A" and incorporated herein by reference as fully as though set
forth at length.
SECTION 3. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
