CITY Q: SAN BI!RNARDINcO Rl!cQl!ST FOR COUNCIL ~TION , STAFF REPORT A petition was filed with the Local Agency Formation Commission (LAFCO), for annexation to the City of San Bernardino, for the territory generally located North of Lynwood Drive, East of Harrison Street. This petition was filed by residents of the proposed area. Before LAFCO can issue a Certificate of Filing, Section 99 of the Revenue and Taxation Code requires that the distribution of property taxes, relative to the proposed boundary changes, be negotiated and agreed upon by all affected local agencies. The County Board of Supervisors shall negotiate with the City, any exchange of property tax revenues on behalf of all affected agencies, except as provided for in Section 99.1 of the Revenue and Taxation Code. Such negotiations between the City and County took place in 1980, when County staff and a committee of City managers agreed upon a formula for property tax transfers, and Resolution 82-325 was adopted June 7, 1982, requesting the Board of Supervisors to direct the establishment of a policy for the formula. The adoption of the attached resolution fulfills the City's. compliance with said Section 99 . Exhibit "A" of the resolution, states the actual dollar amounts proposed for transfer and the local agencies affected. THIS RESOLUTION MUST BE ADOPTED BEFORE THE DEADLINE OF SEPTllKBKR 21. 1989. RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN BERNARDINO AND TIlE COUNTY OF SAN BERNARDINO, RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC 2632, FOR THE AREA GENERALLY LOCATED NORTH OF LYNWOOD DRIVE, EAST OF HARRISON STREET. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. The Mayor and Common Council of the City of San Bernardino hereby find and determine that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior 10 to the issuance of a certificate of filing by the Local Agency Formation 11 Executive Officer, the governing bodies of all local agencies whose service 12 area or service responsibilities will be altered by a proposed 13 jurisdictional change will negotiate and determine by resolution the amount 14 of property tax revenues to be exchanged between and among such local 15 agencies. 16 B. Except as provided in Section 99.1 of the Revenue and Taxation 17 Code, in the event that a jurisdictional change would affect the service 18 area or service responsibility of one or more special districts, the Board 19 of Supervisors of the County of San Bernardino shall, on behalf of the 20 district or districts, negotiate any exchange of property tax revenues. 21 C. The Mayor and Common Council of the City of San Bernardino and 22 the Board of Supervisors of the County of San Bernardino have determined the 23 24 25 26 amount of property tax revenues to be exchanged as a result of jurisdictional change described by LAFC No. 2632. SECTION 2. Implementation. A. The column entitled "Estimated Current Tax Revenue" shall represent the amount of property tax revenues for the current year to be paid to the County of San Bernardino and its affected agencies. B. The annual tax increment generated in the area subject to the jurisdictional change and attributable to the Local Agencies whose service area or service responsibilities will be altered by the proposed jurisdictional change shall be allocated in the future years pursuant to the provisions of Section 96 of the Revenue and Taxation Code. SECTION 3. The City Clerk of the City of San Bernardino is hereby directed to certify to the passage of this resolution and to cause a certified copy to be sent to the Executive Officer of the Local Agency Formation Commission of the County of San Bernardino.
