The applicant requests that the condition be modified so that the condition to construct a six foot high "woodcrete" wall be modified to allow landscaping. BACKGROUND Conditional Use Permit No. 90-07 is a request to establish a U-Haul business within an existing mini-storage facility located at the northeastern intersection of Hallmark Parkway and Lexington Way next to 1-215. The mini-storage was approved on September 6, 1988, and established 15 mini- storage buildings totaling 68,750 square feet on 3.83 acres. The Environmental Review Committee (ERC) recommended a Negative Declaration for the project on April 19, 1990. No comments were received during the public comment period. The Development Review Committee (DRC) had a final review and clearance of the project on May 10, 1990. On June 4, 1990, the Planning Commission approved Conditional Use Permit No. 90-07, by a 6 to 2 vote. The approval requir- ed screening by a "woodcrete" wall around the entire proper- ty. This Condition has been appealed. On July 16, 1990, the Mayor and Council continued the appeal so that alternative amendments to the screening condition could be developed. These have been developed. One alterna- tive is to require a landscaped buffer outside the existing chain link fence on the city's right-of-way. This area is designated for the proposed Pepper Linden Drive and inter- change. A temporary encroachment permit from the Public Works Department would be required and the applicant has applied for this permit (See Exhibit "B"). Another alterna- tive is to require the landscaping on the inside of the fence. However, the amount of landscaping area would need to be restricted so that adequate access lanes can be main- tained. 15-0264 Appeal of a condi~n of Approval for No. 90-07 Mayor and Common Council Meeting of September 5, 1990 Page 2 o Conditional Use Permit OPTIONS AVAILABLE TO THE MAYOR AND COUNCIL The Mayor and Council may deny the appeal and maintain the condition of approval as required by the Planning Commission. OR The Mayor and Council may uphold the appeal and modify the condition of approval for the fence to require that the applicant provide a 10-foot landscaped buffer on the outside of the existing fence on the north and east property lines. OR The Mayor and Council may uphold the appeal and modify the condition of approval for the fence to require that the applicant place a5-foot landscape planter area inside the existing fence. The planter area should be landscaped with dense mature trees and shrubs. The rear access lane shall be maintained at a minimum of 15 feet from building "0" to the planter area. RECOMMENDATION Staff recommends amending Condition No. 6 to allow the applicant to obtain a temporary encroachment permit from the City of San Bernardino and to plant and maintain a 10-foot landscaped buffer area adjacent to the existing property line on the north and east property lines. The site has a frontaqe on Hallmark Parkway of approximately 320 feet and is further described as 5185 Hallmark Parkway (see Attachment "H", Location Map). MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE The proposed U-Haul operation within the existinq mini- storaqe facility is consistent with the Municipal Code and in conformance with the General Plan as shown in Attachment "A". CALIFORNIA EHVrRONMENTAL OUA T.TTY ACT The Initial Study was prepared by staff and presented to the Environmental Review COIIIIIIittee (ERC) on April 19, 1990. The ERC found that no siqnificant impacts will result from the project and recOJlllDended a Neqative Declaration. The Neqative Declaration wa. available for public review from April 26, 1990 to May 3:6, 1990. To date, no cOJlllDents have been received. In June of 1988, "the Planning Department received an application for a Conditional Use Permit to construct a mini-storage facility on'the subject site. Conditional Use Permit Number 88-35 was approved by the Planning Commission on September 6, 1988 and established 15 mj,ni-storage buildings totaling 68,750 square feet. In October of 1989, the applicant's representative filed a sign permit application with the City of San Bernardino. On May 10, 1990, the Development Review Committee, after reviewing the prOposed use, recommended approval with the requir_ents that the applicant park the rental trucks only between Buildings "G" and "H" and Buildings "H" and "L" and that the applicant should screen the mini-storage use with a "Woedcrete" wall. ANALYSiS The applicant requests approval ot a Conditional Use Permit to establish a U-Haul 'rental otfice and accompanying rental truck operation within ~'existing mini-storage facility. The applicant has provided a description of the operational procedures tor the intended use. The procedures for ordering, picking up and returning the trucks are as follows: * CUstomer arrives at the site and parks their car in the parking spaces outside the front gate. * customer goes into the storage/U-Haul' office located in Building "I" and completes paperwork tor rental. . * The on-site manager then delivers the truck to the applicant outside the main gate. ,. -, CITY OF SAN .J ARDINO PLANN' K CASE ..... Opon notice by the City, fifty pe~cent of the latest Conditional Ose Permit appl~cation fee shall be paid by the applicant for the preparation of the evaluation report to the Planning Commission. After the p~lic hearing, the Planning Commission may -modify any existing conditions of ' approval or revoke Conditional Ose Permit Number 90-07. The revised conditions or revocations shall be permanent and subject to appeal to the Mayor and Common Council within fifteen (15) ,days after, ,imposition. The above process of evaluation of the business operation impacts may be required in any subsequent years of operation as determined by the City. Operation quidelines that the owner must follow are: * Compliance with all applicable development standards of the City of San Bernardino. * All signs' shall be in conformance with the San Bernardino Municipal Code. * The business shall be operated in a manner which does not create visual imDacts, does not produce obnoxious nois., or other nuisance. 5. The rental tru~k parking shall be restricted to only those parking spaces between Buildings "G" and "M" and Buildings "H" a~d "L". 6.
