The bonds are paid for by annual assessments placed on the property tax bill through the County. They are submitted to the Auditor and then placed on the County property tax bill. The assessments are then collected by the County and forwarded to the City. The procedures for collection are laid out in the California Streets and Highway Code. In the past for 1915 Acts, the County Auditor has not re- quired the submission of a specific resolution incorporating this Code section dealing with the assessments and their collection. However, this year they are requiring it on any new bond issues. This requirement is in addition to the Resolutions filed with the Recorder's Office. Because of this new requirement, Bond Counsel, Mr. Richard Anderson of Best, Best & Krieger, reviewed the documents for this issue and is recommending the adoption of this additional resolution that will specifically reference those sections of the State Street and Highway Code dealing with the Auditor's responsibilities dealing with the filing and collecting of assessments in relationship to 1915 Bond Acts. This needs to be adopted at the August 6, 1990 meeting so that the assessments can be filed by the County deadline of August 10, 1990. e - . o o 1 2 3 4 5 6 7 8 9 RESOLUTION NO. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO SPECIFYING THE AMOUNT OF THE ASSESSMENTS REMAINING UNPAID AND AUTHORIZING THE COUNTY AUDITOR TO COLLECT THE ANNUAL INSTALLMENTS OF PRINCIPAL AND INTEREST ON SUCH ASSESSMENTS ASSESSMENT DISTRICT NO. 985 (Industrial Parkway Improvement District) WHEREAS, on January 3, 1990, the Mayor and Common City of Council") of the San (the "Common and Council 10 Bernardino, California (the "City"), adopted Resolution No. 89- 11 489 modifying and confirming the assessment for Assessment 12 District No. 985 (the "Assessment District"); and 13 WHEREAS, on February 21, 1990, the Common Council 14 adopted Resolution No. 90-57, determining, among other matters 15 that the assessments remaining unpaid and upon the security of 16 17 18 19 20 21 22 which bonds have been issued for the Assessment District is the amount of $1,101,681.82; and WHEREAS, pursuant to Section 8682 of the Streets and Highways Code, a copy of the order of the Common Council deter- mining the assessments remaining unpaid and upon the security of which bonds have been issued shall be filed in the office of the County of San Bernardino; 23 24 25 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA AS FOLLOWS: Section 1. Unpaid Assessments. County Auditor. A certified copy of this resolution shall be filed with the County Auditor of the County of San Bernardino pursuant to Section 8682 of the Streets and Pursuant to said Section 8682, the County Highways Code. Auditor shall keep a record in his office showing the several installments of principal and interest on the assessments which are to be collected in each year during the term of the bonds: and the County Auditor shall annually enter in his assessment roll on which taxes will next become due, opposite each lot or parcel of land affected in a space marked "public improvement 11 I assessment," or by other suitable designation, the several 12 I installments of the assessment coming due during the fiscal year 13 i.
