STAFF REPORT

The Water Department is upgrading a booster plant station at the
Newmark Plant to boost additional water from the Newmark reservoir
to the Sycamore Reservoir. This will enable the movement of
additional water to the higher elevations in the water system to
serve customers.
The upgrade of the booster station requires additional electric
service to be installed by Southern California Edison Company,
necessitating the granting of an easement for underground conduit
and a pad mounted transformer. It is recommended that the grant
of easement be approved.

CITY OF SAN BERNARDINO. a municipal corporation, (hereinalter r.ferred to as -Granlo!"'), hereby
grant 10 SOUTHERN CALIFORNIA EDISON COMPANY, a corporalion, its succ...ors and assigns (hereinafter
referred to as -Grantee-), an easement and right of way to construct, UN. maintain. operate. alter, add
10, repair. replace. reconstruct, inspec.:t and remove al any time and from time 10 time underground
electrical supply systems and communication systems (hereinafter r.ferred to as .systems.). consisting
of wires. underground conduits, cables, vaults, manholes. handholes. and including above-ground
enclosures, markers and conerlte pads and other appurtenant fixtures and equipment necessary or useful
for distributing electrical energy and for transmitting Intelligence by electrical means. in, on, over,
under, across and along that certain real property in the County of San Bernardino. State of California,
described as follows:
A strip of land, 10 f.el in widlh, lying wilhin Lol 131, ARROWHEAD SUBURBAN FARMS,
TRACT E, TRACT NO. 1748, as per map recorded in Sool< 25, page 59 of Maps, in Ihe Office of the
Recorder of said County; the centerline of said strip being described as follows:
BEGINNING at a point on the Northerly line of 42nd Street, as now established; said point being
distant thereon 494 feet Westerly of the centerline of Magnolia Drive. as now establiShed; thence
Northerly. parallel with said centerline. a distance of 40 feet.
The Grantor agrees for itself, its successors and assigns. not to erect. place or maintain. nor to
permit the erection, placement or maintenance of any building. planter boxes. earth fill or other
structures except walls and fences on the above described real property. The Grantee. and its
contractors, agents and employ.es, shall have the right to trim or cut tree roots as may endanger or
interfere with said systems and shall have free access to said systems and every part thereof, at all
times, for the purpose of exercising the rights herein granted; provided. however, thaI in making any
excavation on said property of the Grantor. the Grantee shall make the same in such manner as will cause
the least injury to the surface of the ground around such excavation. and shall replace lhe earth so
removed by it and restore the surface of the ground to as near the same condition as it was prior to such
excavation as is practicable.

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO GRANTING AN EASEMENT TO SOUTHERN CALIFORNIA EDISON
COMPANY FOR ADDITIONAL ELECTRIC SERVICE AT THE WATER DEPARTMENT'S
NEWMARK PLANT.

NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
6 OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION ONE:
That the City of San Bernardino, a Municipal
Corporation, does hereby grant an easement to Southern California
Edison Company to provide additional electrical service to the
10 Water Department's Newmark Plant, located at 42nd Street, west of
11 Magnolia Drive.
12 SECTION TWO: That the said Grant of Easement referred to
13 herein, a copy of which is attached hereto, marked Exhibit "1", and
14 is hereby referred to and made a part hereof as fully as though
15 set forth at length herein, is hereby approved.
16 SECTION THREE: That the Mayor and City Clerk of the City of
17 San Bernardino are hereby authorized and directed to execute said
18 Grant of Easement on behalf of the City of San Bernardino.
19 I HEREBY CERTIFY that the foregoing resolution was duly
20 adopted by the Mayor and Common Council of the City of San
