Synopsis of Previous Council action:
09-20-89 -- Appeal hearing on Planning Commission's decision to require an
Environmental Impact Report for Tentative Tract No. 13554 closed,
appeal upheld, and directive given that a focused Environmental Impact
Report not be required or prepared; and that the Planning Commission be
directed to consider Tentative Tract l!o. 13554 subject to certain
condi ti ons and to revi e\~ and revi se the Initi a 1 Study and Mi ti gati on
Monitoring Plan.
04-16-90 -- Request from Forecast Corporation that the City participate in the cost
of installing Master Plan Storm Drain 7-B18 in "H" Street, from Little
Mountain Basin to Northpark Boulevard, approved, in .an amount equal to
the Storm Drain Fee, paid by Tract No. 13554.
Recommended motion:

1. That the Director of Public Works/City Engineer be directed to issue a letter
to the San Bernardino County Flood Control District assuming full responsibil-
ity for maintenance and operation of the 69-Inch Storm Drain and Outlet
Structure, for Master Plan Storm Drain 7-BI8, located on the District's Little
Mountain Dam (Basin) ,pursuant to Permit No. P-290042.

STAFF REPORT
e
Forecast Corporation will be installing Master Plan Storm Drain No. 7-B18 in
"H" Street as a condition of approval for Tentative iract No. 13554. The low
bid price for this storm drain is $922,069.24. At the Council Meeting of
4-16-90, approval was given for the City to participate in the cost in the
estimated amount of $294.580.00.
The storm drain will vary from 42" to 69". A portion of the 69" pipe, with an
appropriate outlet structure, will be located within the San Bernardino County
Flood Control District's Little Mountain Basin. Permit No. P-290042 has been
issued by the County Transportation/Flood Control Department to Forecast
Corporation for work to be done within their right-of-way for Little Mountain
Basin. A copy of this permit is attached for reference.
Paragraph No.5 of this permit states:
"Prior to beginning any activity authorized in this permit, the
Permittee shall provide to the District written confirmation from
the City of San Bernardino accepting full responsibility for the
maintenance and operation of the 69-inch RCP storm drain and outlet
structure upon completion of construction."
The Forecast Corporation has requested that the City issue such a letter to
the District, in order that their Contractor can start work. Authorization
will be needed from the Mayor and Council to issue a letter accepting
responsibility, since it will entail committing City Funds.
Maintenance of the portion of the Master Plan Storm Drain within District
right-of-way would seem to be their responsibility. Therefore. we are unable
to recommend that authorization be granted to issue a letter assuming
responsibility for maintenance.
The City will naturally assume maintenance of the portion of the storm drain
installed in City streets.

make all contractors doing work on this project familiar with all of the
requirements of this pemit.
