Recommended motion:

That the appeal of Mr. Eugene M. Villarreal relative to the assessment made by the
Beare of Building Commissioners with regard to the abatement of debris from property
located on "J" Street be denied and the decision by the Board of Building
Commissioners be upheld.

STAFF REPORT
On November 10, 1989, a "Notice to Clean Premises" was mailed to
Mr. Eugene M. Villarreal, 818 Mission Drive, San Bernardino, CA 92410,
regarding property Parcel No. 0144 131 49, located on "J" Street, north.
of 16th Street. A copy of the notice is attached.
The above parcel required removal of debris and this was done by H
& H Enterprises on February 28, 1990, (the removal consisted of cleaning
and hauling of debris at a cost of $60.00. The ;:ldrninistration fee of
$75.00 was added to this charge for a total amount due of $135.00).
On March 30, 1990, along with his bill, Mr. Villarreal was sent a
notice of hearing before the Board of Building Conmissioners, scheduled
for May 4, 1990, regarding the assessment costs for the abatement of his
parcel. Because Mr. Villarreal filed his written protest past the
deadline, his protest was postponed to be heard at the June 1, 1990
hearing. Mr. Villarreal was notified of the change of hearing.

The hearing on the assessment on Mr. Villarreal' s property was held
on June 1, 1990. Evidence was presented to the Board of Building
Conmissioners regarding Mr. Villarreal' s abatement and assessment costs.
Based on the evidence presented, the Board unanimously adopted the sum
of $135.00 to be assessed against Mr. Villarreal and ordered that a lien
be placed on their property, if the assessment was not paid.
