COSTS OF SAID SERVICES KNOWN AS ASSESSMENT DISTRICT NO. 994, AND ORDERING THE WORK. , 2 3 4 5 6 7 8 9 WHEREAS, the Mayor and Common Council of the City of San Bernardino have preliminarily found that the public interest, convenience, and necessity require City-wide street lighting and street sweeping services, as more fully hereinafter described, and the appurtenances and appurtenant work and incidental costs and expenses in connection therewith, that the project is feasible, and that the lands to be assessed will be able to carry the burden of the proposed assessments to pay the costs and expenses thereof; and WHEREAS, the Mayor and Common Council of the City of San Bernardino have, on the 4th day of June, 1990, passed and adopted Resolution No. 90-207 entitled: "RESOI.UTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE FORMATION OF A STREET LIGHTING AND STREET SWEEPING ASSESSMENT DISTRICT; DECLARING ITS INTENTION TO PROCEED TO ORDER WORK WITHIN 23 24 25 26 THE DISTRIC~, TO BE KNOWN AS ASSESSMENT DISTRICT NO. 994 AND SETTING AND DIRECTING PUBLICATION OF NOTICE OF A TIME AND DATE OF A PUBLIC HEARING.", 27 / / / 28 DAB/ses/994.res July 16, 1990 1 .: ~V i?';J. -0 . o o 1 Which said resolution duly and legally was published and 2 notice has been given in the manner required by Chapter 12.90 of 3 the San Bernardino Municipal Code; and written objections and 4 protests to the formation of the proposed district, the work to 5 be done or the extent of the district to be assessed were heard 6 and considered. 7 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 8 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 9 SECTION 1. That a full and fair public hearing having been 10 held, as stated in the recitals herein, and the Mayor and Common 11 Council, having heard and considered any and all comments 12 received thereon and being fully advised in the premises, hereby 13 overrules any and all protests received. 14 SECTION 2. That the public convenience and necessity 15 require, and the Mayor and Common Council of the City of San 16 Bernardino hereby declares, that the public interest, 17 convenience, and necessity requires and hereby orders, the 18 formation of Assessment District No. 994; the work described in 19 said Resolution No. 90-207 to be done within the Corporate City 20 Limits of the City of San Bernardino as provided in said 21 Resolution. 22 SECTION 3. The work is proposed to be carried out by City 23 forces. If it is determined that the needs require an outside 24 contract, then the City Clerk hereby is directed to post a Notice 25 for five days on or near the door to the Council Chambers of the 26 City Hall inviting sealed proposals or bids when necessary, for 27 doing the work ordered and referring to the specifications on 28 DAB/ses/994.res July 16, 1990 2 '0 . o o c 1 file and to publish a Notice Inviting such proposals for at least 2 two days in the San Bernardino Sun, a newspaper published and 3 circulated in said City. 4 SECTION 4. If a contract is let, the contract will be 5 awarded pursuant to the standard procedures used by the City in 6 the award of Public Works contracts and the work ordered 7 hereunder shall be to the satisfaction of the City Engineer of 8 said City, and all said work shall be done under his direction 9 and shall comply with the specifications prepared by him, and 10 upon the completion of said work, whether by City forces or by 11 outside contract, the City Engineer shall, and he hereby is 12 directed to make the assessment. 13 SECTION 5. Reference hereby is made to said Resolution 14 No. 90-207 for a description of the work, the extent of the 15 assessment district, the financing alternatives and for further 16 particulars. 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 6.
