Synopsis of Pnvious Council ection:
5/21/90 -- Mayor and Common Council approved the allocation of
$100,000 from bond proceeds for the purpose of funding
the City's participation in the removal of existing driveway
approaches, infilling of curb depressions and reconstruction
of curb, gutter and sidewalk.
Adopt resolution.

At the May 21, 1990 ...tiJlC1, the Mayor and C~n Council
approved the allocation of' $100,000 froa bond proceeda for

sidewalk.
The attached re~lution pJ:ovi.. a procedure for a property
owner involved in a Cbapter 12.'2pJ:OCeed!Jl9 to reque.t City
participation. The City will notlf'y all property owners of
the procJr" and provide all ~.",J:y infoftlation and forms
for participation. Proper'ty,..n will be given a specified
ti.e period in which to J:.~ city participation. After
the tiae period bas el~ and participation is not
requeRed, the iIIIproveaents will be constructed purauant to
Cbapter 12.92 with the full c~t to be borne by the property
owner.
Based on the lilllited fund!Jl9, 1:h1s program is only structured
for driveway projects under ebapter 12.92.

RESOLUTION OF THE CITY OF SAN BERNARDINO RELATING TO
PROCEDURE FOR CITY-PROPERTY OWNER PARTICIPAT:EON IN THE REMOVAL
OF EXISTING DRIVEWAY APPROACHES AND INFILLING OF CURB
DEPRESSIONS AND RECONSTRUCTION OF CURB, GUTTER AND SIDEWALKS
LOCATED ON THE PUBLIC RIGHT-OF-WAY.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. In order to expedite the removal of existinq
driveway approaches and infillinq of curb depressions and
reconstruction of curb, qutter and sidewalks, the City may pay
one-half the cost of such work.
SECTION 2. Eliqible projects for City participation of
one-half the cost shall be only those projects for which the
city has initiated Chapter 12.92 proceedinqs of the San
Bernardino Municipal Code.
SECTION 3. This resolution does not apply to sidewalk,
parkway, curb and qutter improvements required of a property
owner as a condition of obtaininq a buildinq permit, conditional
use permit or other type of development permit.
SECTION 4.
The work hereunder may be performed by a
private contractor enqaqed by the property owner or by the City
followinq application
to the Public Works Department for
participation in the proqram.
a. The Public Works Director will advise of the City'S
participation proqram in the Notice to Construct as
required by Chapter 12.92
and
enclose an
application form.
In the event a property owner
fails to respond within the specified timeframe or
declines to participate in the proqram, the
improvements shall be constructed by Public Works

Department under the Chapter 12.92 proceedinqs. The impr-
ovements will be constructed on a mandatory basis, with the full
cost thereof to be borne by the property owner.
b. The property owner will have 5 days after the
hearinq date on the Notice to Construct in which to
submit the application form.
c. Applications, outlininq the work to be performed,
shall be completed on forms to be provided by the
Public Works Department.
d. The Public Works Director shall have an inspection
made of the project: estimate the cost of the work:
and advise the property owner in the Notice to
Construct of the dollar amount of the one-half cost
contribution.
e. The property owner will have the option of havinq
work performed by a private contractor selected by
the City or by the property owner.
In no event
will the amount of the City's contribution exceed
the sum determined in (d) above.
f. If, after a determination is made in pursuant to
(d) above, and a property owner prefers to have a
private contractor perform the work, the Public
Works Director followinq final inspection and
approval of the work by the City, and upon the
presentation of receipted bills or invoices, shall
authorize 50t of the actual cost of the project or
the sum determined pursuant to (c) above, whichever
is less, to be paid to the property owner.
q. In the event a property owner elects to have the

work performed by a private contractor, the contractor shall
apply for and receive a no-fee permit issued by the Public Works
Department.
