STAFF REPORT
'Ibis action is the rtlllult of a request fro. the developers of McClellan
bevelopaent in response to the City to establish an assess.ent district for
the _intenance of landscaping along portions of Eucalyptus Avenue, South of
Mill street.
On April 16, 1990, the Resolution of Intention to AIIend the Boundaries of
AssessMDt District No. 975 was adopted which declared the City's intention
to proceed with the expansion of the District to include additional
territory within the boundaries of the District.
Due to the fact of 1001 participation b,y the owners of the area to be included in the
district, notice and hearing was not necessary (Section 12.90.040C(5) of the Municipal
Code) and this Resolution is the next fOrRI step in the proceedings.

No. 975 for the uintenance of lUIId8caping in the area of Hi II Street and
Pepper Avenue; and

have preli.inarily found that the public interest. convenience.. and
necessity require the uend~rrt. of the boundaries of Aasess.ent District No.
975 by the expansion thereof to include additional territory; and
WHEREAS. the Mayor and C~on CO\Dlcil of the City of San Bernardino
have. on the 16th of April. 1990. passed and adopted Resolution No. 90-127
entitled:

which said resolution indicated that the City elected to proceed without
Notice and Bearing pursuant to Section 12.90.040C(5) of the M\DliCipal Code as
the request to expand the boundaries of the existing District represents 1001
of the property owners liable to be assessed for the said lIaintenence.

THE CITY OF SAN BERNARDINO AS FOLLOWS:

5 tho a 4/5tha vote as defined in Section 12.90.0400 of the SlID Bernardino
6 ltunicipal Code. that the public interest. convenience. lIDd necesaity requires
