SAN _RNARDlNC6 R.....T FOR COUNCIL ~ STAFF REPORT Subject: Appeal of a Condition of Approval for Conditional Use Permit No. 90-07 Mayor and Common council Meetinq July 16, 1990, 2:00 p.m. REOUEST . The applicant, Larry Banqert, is appealinq a condition of approval for Conditional Use Permit No. 90-07. The applicant requests that the condition be modified so that the condition to construct a six foot hiqb -weodcreteW wall be modified to allow the installation of redwood slattinq in the already existinq six foot hiqb chain link fence. BACKGROUND Conditional Use Permit No. 90-07 is a request to establisb a U-Haul business within an existinq mini-storaqe facility located at the northeastern intersection of Hallaark Parkway and Lexinqton Way next to I-215. The Ilini-storaqe was approved on September 6, 1988, and . established 15 mini- storaqe buildinqs totalinq 68,750 square feet on 3.83 acres. The Environmental Review Committee (ERC) reco_ended a Neqative Declaration for the project on April 19, 1990. No cOmments were received durinq the public comment period. The Development Review Committee (DRC) bad a final review and clearance of the project on May 10, 1990. BASYS AND ANALYSIS OF APPEAL The applicant is objectinq to the cost of installinq a "woodcreteW cement screeninq fence around the Ilini-storaqe/U- Haul business and that such a fence will not provide visual screeninq. (See Exhibit "A") The appeal request is reasonable in that a abain-link fence is already constructed around the project and red-wood slattinq would provide the screeninq desired for the parkinq and circulation areas. OPTIONS AVAILABLE TO THE MAYOR AND COUNCIL The Mayor and Council may deny the appeal and maintain the condition of approval as required by the Planninq Commission. OR The Mayor and Council may uphold the appeal and Ilodify the condition of approval for the fence to require red-wood slattinq in the existinq chain link fence. 75~0264 o . . .
