12.93 TO THE SAN BERNARDINO MUNICIPAL CODE TO PROVIDE Foa CITY

THE MAYOR.AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION 1:
Chapter 12.93 is hereby added to the
7 San Bernardino Municipal Code as follows:
8 .CITY PARTICIPATION IN SIDEWALK/CURB REPAIR
9 AND SEWER CONNECTION COSTS
10 12.93.010 Participation by City.

A.
Notwithstanding other provisions of this Code, the
12 Streets and Highways Code or any other provision of law, the
13 City, at its discretion, may contribute fifty per cent (SOt) of
14 the costs to be paid by the property owner for repair of existing
15 sidewalk, curb, gutter or paved parkway improvements. The Public
16 Services Director shall determine when to contribute the fifty
17 percent (Sot) based on the cost of the repair, the ability of
18 the property o~er to pay, and the cooperation exhibited by the
19 property owner. Such determination shall be subject to appeal to
20 the Mayor and Common Council pursuant to Chapter 2.64 of this
21 code.

B.
Notwithstanding other provisions of this Code, the
23 Streets and Highway Code or any other provision of law, the City,
24 at its discretion, may waive fifty percent (SOt) of the
25 installation costs to be paid by the property owner for
26 connection of the sewer line from the lateral to the property
27 line for an existing owner-occupied single family residence when
28 installed by the Public Services Department. The Public Services

1 Director shall determine when to waive the fifty percent (SOt)
2 based on the cost of the installation, the ability of the
3 property owner to pay and the length of time the owners of the
4 property have paid a monthly sewer service charge. Such
5 determination shall be subject to appeal to the Mayor and Common
6 Council pursuant to Chapter 2.64 of this Code.
7 12.93.020 Administration.
8 The Director of Public Services may promulgate written
9 procedures, regulations, guidelines and fees pertain~g to the
10 implementation of this chapter. Such procedures, regulations,
11 guidelines and fees shall not become effective until approved by
12 resolution by the Mayor and Common Council."
13 Section 2. Section 12.92.080 of the San Bernardino
14 Municipal Code is hereby repealed.
